Official Rules of the Airbnb "UK Pub Makeover" Competition

YOU MUST BE REPRESENTING A LICENSED PUBLIC HOUSE IN COMPLIANCE WITH THESE OFFICIAL RULES IN ORDER TO BE ELIGIBLE TO ENTER THIS COMPETITION. IF YOU ARE NOT A RESIDENT OF THE UNITED KINGDOM, YOU WILL NOT BE ELIGIBLE TO PARTICIPATE IN THE COMPETITION. NO ADDITIONAL PURCHASES OR PAYMENTS ARE REQUIRED TO PARTICIPATE.By entering this competition ("Competition"), you agree to these terms and conditions ("Official Rules"). The "Interpretations and Disputes" Clause below contains information about the applicable law and jurisdiction governing these Official Rules. If Airbnb provides translations of these Official Policies, the English version shall prevail in the event of any inconsistencies.Promoter"Airbnb" means the promoter ("Promoter") of this Competition and your contractor as described below: Airbnb Ireland UC, a company registered in Ireland under Company Number 511825 whose registered office is at 8 Hanover Quay Dublin 2, D02 DP23 Ireland. Airbnb's employees and suppliers instrumental to the success and organisation of the Competition are referred to, together with the Promoter, as "Organisers" hereinafter."Country/Region of Residence" means the state/jurisdiction associated with your Airbnb Account, as determined by Airbnb based on the option you select or the determination of your residence based on the various data associated with your Airbnb Account. As further described in these Rules, the Competition is open to residents of the United Kingdom.The CompetitionThe purpose of the Competition is to identify the Entrants who will win the Prizes ("Winners"). The Competition will be open from 00:00 GMT on 27 November 2024 until 00:00 GMT on 31 December 2024 (“Entry Period”).To be considered for the Prizes (an "Entrant"), you must meet the eligibility conditions set out below, and must enter the Competition during the Entry Period by following the procedure set out below.  Entrants must have access to the Internet in order to enter the Competition. Submissions received after the Entry Period or submitted by any other means will be ineligible and will not be considered.The PrizesThree (3) Winners will each be awarded the following prize (“Prize”):
  1. A non-structural, cosmetic makeover of one spare room in the pub property carried out by a third party supplier selected by the Promoter, including but not limited to: paintwork, art work and soft furnishings (works must be underway by 1 March 2025); and
  2. A 30 minute hosting support session from an Airbnb Community Manager (must be used before 31 December 2025).
The Prizes do NOT include any additional expenses, taxes, or disbursement of money.Only the three (3) Winners will receive a Prize, subject to these Official Rules. No substitution or transfer of the right is permitted, nor will it be possible to convert the Prizes into cash. This is without prejudice to any decision of the Promoter regarding the Reserves, as set out below.Unforeseen circumstances or any changes that may affect a Winner's ability or willingness to participate or claim their Prize will not entitle them to receive any compensation, alternative opportunity or cash payment. The total value of each Prize is approximately £10,000 and is awarded in services only. The Winner will not receive the difference between the approximate amount and the actual Prize amount. The Promoter reserves the right to exceed this amount up to a total value of £15,000 at its discretion.In the event that the Promoter deems it appropriate to change the proposed Prizes, they will be replaced with other Prizes of equal value.By accepting the Prize the Winners agree to list the spare room in which the makeover is carried out on Airbnb for a period of at least twelve (12) months after the conclusion of the makeover (“Competition Term”) and host on Airbnb at least three (3) times during this period. EligibilityTo be eligible for the Competition, you must meet the following Eligibility Criteria:
  • have an Airbnb account and be aged 18 or over,
  • be a UK resident,
  • own or represent a licensed and operating pub in England or Wales with a spare room suitable for overnight stays (including a dedicated sleeping space with a private door and access to a private or shared bathroom) that does not require any form of planning permission to redecorate and is not in a listed building,
  • apply before 11:59pm GMT on 31 December 2024 at the Site,
  • not be otherwise deemed ineligible under these Official Rules.
In order to redeem the Prize, the Winner must be deemed by the Organisers to meet the eligibility requirements both at the time of Entry and at the time the Prizes are being awarded.Anyone who is in any of the following capacities is not eligible to participate in the Program: Any director, officer, employee, independent consultant, advertiser, and agent, including those in subsidiaries or affiliates of Airbnb (collectively, "Released Parties"), as well as their immediate family members or household members (including, but not limited to, spouses, partners, roommates, children, parents, siblings, grandparents, and grandchildren).Winners undertake to verify and comply with all laws, regulations, and health and safety provisions to ensure the use of the Prizes.How to participateIf you do not have an Airbnb account, you can create one here: https://www.airbnb.co.uk/login?redirect_url=/help/article/221.Log into your Airbnb account and follow the below steps:
  1. Visit www.airbnb.com/e/pubmakover ("Site");
  2. Click on the "Apply here" button;
  3. Accept these Official Rules; and
  4. Submit an Entry by completing the form and providing all the required personal and contact details, submitting the requested motivation text and answering all mandatory questions ("Entry").
You can only submit one Entry to the Competition. By submitting an Entry, you declare that you are at least 18 years old at the time of registration, meet all Eligibility Criteria, and reside in the United Kingdom.To the fullest extent permitted by law, the Promoter and the Released Parties shall not be liable for (i) computer or network problems with servers and email accounts; (ii) failure to receive any Entries for any reason beyond their reasonable control; or (iii) any other errors of any kind relating to the Competition, whether mechanical, technical, network, printing, typographical, human or otherwise, including administrative errors or problems with the administration of the Competition, the processing or revision of Entries, the announcement of the Winners, or the presence in any materials related to the Competition.If the Organisers become aware of any fraud, cheating, or similar action taken in connection with the Competition or otherwise, or of any act or omission likely to have an adverse effect on the Competition or its reputation, they reserve the right, in their absolute discretion, without notice and/or reason, to exclude an Entrant from the Competition. Winner Selection The Winners will be selected by a panel of judges (“Jury”) consisting of five (5) members (“Judges”):
  1. Representative of Airbnb
  2. Representative of  CAMRA - Campaign For Real Ale
  3. An Airbnb host
  4. Independent judge 
  5. Independent judge 
Entries will be selected by the Jury and Winners will be chosen subject to the following criteria (“Selection Criteria”):
  • Creativity and originality: have you provided sufficient detail? Why do you want to win? How will you be a great host? What does your pub offer the community or industry i.e. independence, cask ale available, sustainable practices?
  • Proof of your licence to operate, in compliance with local laws and regulations. 
The decisions of the Judges are final and binding. If substantially similar Entries are submitted by different Entrants, the Judges will select only the best version of that idea, in their sole discretion.To the extent permitted by applicable law, the Organisers may, at their discretion, take steps to verify the information you provide and any other elements that may be deemed relevant to your Entry. By entering the Competition, you expressly acknowledge and agree that, if you are chosen as a Winner, you may be required to provide additional information about yourself in order to participate, such as: written confirmation or proof of eligibility, including proof of UK residence or licence to operate. In the event of any ties or hung juries once judging has been completed, a further independent judge will be brought in to review the Entries and provide their opinion based on the Selection Criteria. Winners Notification/Announcement The Winners will be selected by 14 January 2025 and will be notified by 20 January 2025 by email to the email address indicated in their Entry. Failure to comply with these Official Rules may result in, at the discretion of the Organisers, the exclusion of a Winner from the Competition and the selection of another and different Winner ("Reserve") for the relevant Prize. In the event of a dispute as to the identity of a Winner, the Prize will be awarded to the authorised owner of the Airbnb account from which the winning Entry was submitted, provided that such person meets all eligibility requirements. The Winner's name and/or country/region of residence may be published within thirty (30) days of the close of the Competition, including through press and social media channels such as Twitter (e.g. @airbnb) and Facebook. Such announcement may include images submitted as part of a Winner’s Entry. To this end, each Winner undertakes to sign a specific Release, as detailed below.Prohibited content Entries or content including imagery submitted as part of the Competition must be the original work of the Entrant, must not have been previously posted, and must not include the images of people or other personal data or otherwise infringe the rights of any third party, including but not limited to intellectual property rights or rights to privacy, publicity or other moral rights. Entries must comply with Airbnb’s Content Policy (https://www.airbnb.co.uk/help/article/546) and must not contain:(i) the approval or promotion of illegal or harmful activities; (ii) violent, profane, vulgar, obscene, defamatory or otherwise objectionable material; (iii) adult material; or (iv) defamatory content (“Prohibited Content”). Organisers reserve the right to disqualify any Entrant who submits Prohibited Content, in Organisers' sole discretion. Licences & PermitsBy submitting an Entry, you grant the Promoter a non-exclusive, perpetual (i.e. for the duration of the protection afforded by the relevant intellectual property rights), worldwide, irrevocable, fully paid-up and royalty-free licence to transform, edit, modify, reproduce, distribute, sublicense, transmit, publish, communicate to the public, broadcast, exhibit, display or otherwise use your Entry, in whole or in part, with or without modification, in any format or medium (including: Internet, any print media distributed in print, billboards, point-of-sale advertising, flyers, brochures, etc.) existing or hereafter developed, for any purpose, including entertainment, promotion and/or advertising. To the fullest extent permitted by law, you agree to waive in favour of the Organisers and to refrain from asserting or invoking any so-called moral rights in relation to your Entry (including the right to be identified as the creator of the work and the right to object to derogatory treatment of the work). By participating, you warrant and certify the originality of your Entry, as set forth above, and that you have all necessary rights and consents, including approval of exchange control where required, to submit your Entry and grant each of the Organisers the rights set forth in these Official Rules, as well as to have the consent of any person identified, depicted or mentioned in your Entry. In accordance with the provisions of the law of the competent jurisdiction, you, the Entrant, shall indemnify and hold harmless the Organisers from any liability for any violation of these provisions.By entering the Competition, you agree to be contacted by the Promoter and their respective agents or partners in relation to the Competition and/or the Prizes; agree to provide documents reasonably requested in support of your Entry, including signed releases, consent forms and eligibility documents as requested; grant the Promoter the right to process your personal data in accordance with the Airbnb Privacy Policy and any additional privacy terms applicable to the Competition in which you are entering, as set out in the Personal data section below; agree to participate in any publicity subsequent to the Competition and/or the Prizes; agree to be filmed, photographed and otherwise recorded (including voice, image, appearance, performance, etc.) during the Competition and the Prize, including recording any statements about the Competition, the Prizes, the Organisers and the activities, experiences and opinions of the Competition, such recordings may also be used by such Organisers for any promotional or other purposes on an ongoing basis throughout the world. Winners will have no rights to such materials.Non-disclosureBy entering the Competition, you agree not to disclose any contact you receive from the Organisers in relation to your Entry, including whether you have been shortlisted, identified as a Winner prior to announcement, or efforts to verify information provided by you. A failure to comply with this non-disclosure requirement may, at the Organiser’s discretion, disqualify you from the Competition. As a requirement of accepting their Prize, Winners will be required to sign a non-disclosure agreement.General DisclaimerExcept as required by any applicable laws, the Prizes will take place as set forth in these Official Rules and, to the fullest extent permitted by law, are offered as is, without any express or implied warranties or conditions. This Competition may be subject to binding local laws and regulations, including tax laws. The Winners are solely responsible for any taxes or contributions applicable to or resulting therefrom in their respective participation in the Prizes.In the event that, at a time after the Winners are announced, the Organisers discover issues with the property that deem it unsafe for use as a short-term let property or requiring extensive or structural repairs that go beyond the scope of the Prize, the Organisers are entitled, at their discretion, to disqualify the Winner and select a replacement Winner from the Jury’s shortlist.By participating in the Competition, the Entrant releases the Parties from any liability whatsoever and waives, to the fullest extent permitted by applicable law, any claim or action arising out of or in connection with the Competition, its administration and/or redemption of the Prizes (including any travel or activities related thereto). However, nothing in these Official Rules limits or excludes the liability of any individual or entity for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law. Any offering by the Winners of the Prize-winning property on the Airbnb platform or competing platform, any content published in the listing for such property, and any bookings resulting therefrom are the Winners’ sole responsibility, are not in any way considered part of the Competition, and the Promoter takes no responsibility for such listing or the Winners’ other dealings. The Winners acknowledge that any listing created and/or published by them in the course of the Competition will only be endorsed by the Promoter as part of the Competition at the Promoter’s sole discretion, and any such endorsement is expressly limited to the Competition Term. All warranties and conditions, whether express or implied by statute, common law, or otherwise, including any warranty of performance or results Winners may obtain in relation to this Competition, and any warranty of satisfactory quality, merchantability or fitness for a particular purpose in connection with the Prize and all risk relating thereto shall lie solely with the Winners. To the extent permitted by law, Winners the Prize is provided “as is”, and the entire risk as to its satisfactory use and performance for any purposes lies with the Winners. Personal data For the purposes of administering the Competition, it is necessary to collect, review and store the personal data of the Entrant (e.g., name, contact information, and Entry) ("Competition Personal Data"), in the event that you win. The submission of Competition Personal Data by Entrants to the Promoter is therefore necessary for the purpose of participation. If an Entrant does not provide Personal Data for the Competition, they will not be able to participate in the Competition or redeem a Prize. The purpose of processing Competition Personal Data for the Competition is to enable the Promoter to perform its contractual obligations under these Official Rules. The Promoter may share Competition Personal Data for the Competition with its employees, the Jury and third party suppliers for the purposes of administering the Competition and the Prizes, qualifying them from time to time as Data Processors for the same purposes.You hereby acknowledge, agree and confirm that the purpose, nature, period, and duration of any use of such Personal Data is necessary for the purposes of administering the Competition and that such use is therefore a necessary condition of the Competition. You further acknowledge that the Promoter and its contributors may, in their sole discretion, carry out legally compliant background checks in order to ascertain or confirm your eligibility to enter the Competition and, where applicable, to redeem a Prize.In some circumstances, the Promoter may need to obtain additional Competition Personal Data from you. In such circumstances, the Organisers or their partners will ask for your consent to the processing of such Competition Personal Data in accordance with the applicable laws and, where necessary, to the sharing of the same with third-party providers. More information about Airbnb's processing of Personal Data, the data storage periods, and the Winner's rights with respect to Personal Data can be found in the Privacy Policy, available at https://www.airbnb.com/terms/privacy_policy, which applies to you as an Airbnb user.General Provisions Applicable law and jurisdiction The promotion and these Official Rules, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and Entrants can bring legal proceedings in respect of the promotion and these terms and conditions in the English courts. Entrants living in Scotland will also benefit from any mandatory provisions of Scottish law and can bring legal proceedings in respect of the promotion and these terms and conditions in either the Scottish or the English courts. Cancellation, suspension, modificationYou acknowledge that, subject to applicable law and any approval that may be required, the Promoter may cancel, suspend, modify or terminate the Competition if they deem it necessary or appropriate for reasons or circumstances beyond their reasonable control. Such reasons or circumstances include, but are not limited to, fire, storm, flood, earthquake, explosion, war, invasion, rebellion, sabotage, epidemic, labour disputes, any act or threat of action that endangers air travel, and any act or omission (including law, regulation, disapproval or lack of approval) of any third party (including subcontractors, customers, governments, or government agencies). In addition, you waive and release the Released Parties from any claim or action arising out of, or related to, any such cancellation, suspension, modification or termination, to the fullest extent permitted by applicable law. No transfer, refund, redemption, substitution, cash equivalent or substitution of the Prize by any Entrant or Winner is also permitted.If any provision or part of a provision of these Official Rules is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such a modification is not possible, the relevant provision or part thereof shall be deemed to have been deleted. Any modification or deletion of any provision or part thereof under this clause shall not affect the validity and enforceability of the remainder of these Official Rules. To the fullest extent permitted by applicable law, the Promoter may suspend, modify or terminate the Competition if it believes, in its sole discretion, that a malfunction, error, disruption or damage is or will impair the administration, security, fairness, integrity or proper conduct of the Competition; in such event, the Winner will be selected from among the eligible Entries received that have not been affected by the issue, where possible, or as otherwise deemed fair and appropriate by the Organisers.
