Great property for large families or groups! Located in a peaceful setting on 10 acres populated with deer & elk just 5 minutes to Pagosa's uptown dining, shops, &grocery store 35 minutes to Wolf Creek Ski area. Firewood stocked so that you can relax by the rock fireplace in this cozy cedar loghome. You will enjoy the comfort of the 3 level layout, with flatscreens throughout allowing space for all. Smart TVs in living area &loft to use Netflix, Hulu, etc. Board games, books, & movies galore!

The space

Located one mile off of highway 160 on well maintained road.

Lower level (sleeps 5). Queen bedroom with 32" flatscreen with DVD player & Direct TV and closet. Bunk bed room twin on twin with extra twin trundle (sleeps 3). Full bath with jetted tub and 2 person sauna.

Main level (sleeps 2). King master bedroom with 72" flatscreen with DVD and Direct TV. Full bath. Living area with smart TV, dining area, and kitchen. 2 dining tables that seat up to 12 combined.

Loft level (sleeps 7) King bedroom with 42" flatscreen, 1 twin in cozy nook room, Queen sleeper sofa in the loft for 2, daybed that sleeps one, and an additional twin mattress with space in the loft if additional bedding is needed. Loft includes smart TV and comfortable space for entertaining.

Guest access

Enjoy total use of the house and two-car garage and plenty of parking with the circle driveway.

RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Circle R Ranch and The Person Making the Payment as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.Property: The property is located at:
a.976 Hersch Ave, Pagosa Springs, CO
b.The property is furnished and includes: refrigerator, stove/oven, dishwasher, TVs, cable, kitchen utensils, plates, bowls, cups, bed linens, and bathroom towels.
c.Check-in: 4:00pm on__________________Check-out date: 10:00am on_________________________

2.Rental Party: the rental party responsibly during the noted lease is: The Person Making Payment
3.Maximum Occupancy: The maximum number of guests is limited to 14 persons
4.Term of the Lease: The lease begins at 4p.m on the “Check-in Date” and ends 10 AM on the “Checkout Date”
5.Minimum Stay: This property requires a 2 night minimum stay. Longer minimum stays may be required during holiday periods.
6.Rental Rules: Guest agrees to abide by Rental Rules attached at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by following rules at all times while at the property.
7.Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
(URL HIDDEN) Deposit: A reservation deposit of $500 is required in order to reserve your requested dates. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (7) days of departure, provided the following provisions are met:
•No damage is done to unit or its contents, beyond normal wear and tear.
•No charges are incurred due to contraband, or collection of rents or services rendered during the stay.
•All debris, rubbish and discards are placed in trash can, and soiled dishes are placed in the dishwasher and cleaned.
•All charges accrued during the stay are paid prior to departure.
•No linens are lost are damaged.
•The renter is no evicted by the owner (or representative of the owner) or the local law enforcement.
•All check-out procedures are completed by renter.
9.Payment- The total payment of rent, fees and taxes are due 30 days before arrival.
10.Cancellation Policy- Cancellations that are made more than thirty (30) days prior to the arrival date are subject to a 10% cancellation fee of total invoice, including the deposit. Cancellations or changes that result in a shortened stay or no stay, that are made within 30 days of the arrival date, forfeit the full payment of nightly rental fees plus taxes. If we are able to re-rent this home during those cancelled nights, you will receive the full refund minus 10% of total invoice. Early depature does not warrant any refund of rent. A minimum of $100 will be charged for a cancellation. The (SENSITIVE CONTENTS HIDDEN) service fee is not able to be refunded, so the guest is responsible for paying this as well as for any cancellation/change in nights stayed, not the owner/property manager.
11.Insurance: We encourage all renters to purchase traveler insurance.
12.Payment: acceptable payment methods are personal check, Visa, MasterCard, or Discover.
13.Occupancy. By signing below, I (we) hereby agree that the number of occupants for the duration of this lease, are in fact, the number listed on the first page of this contract. I understand that this home is organized around having no more than 14 people.
14.Release of Liability: I (we) hereby voluntarily accept all risk of personal injury, death and property damage (including personal property) to myself (ourselves), our family or anyone on the Premises with our permission, which injury or damage results from our use of the Premises. Furthermore, I (we) agree that I (we) will not make a claim against or sue the Owners, its owners employees, family, or related entities, for any bodily injury, death, or property damage. I (we) understand that this is a release of Owner and agents from any and all liability with respect to any claims brought by invitees for any damage or injury.
Rental Rules
The home is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. By signing below, you are agreeing to abide by all the following rules:

1.Smoking is NOT permitted in the home or anywhere on the property
2.No loud music, TV, or voices
3.Do not store any items outside the home, nor inside where damage may be caused i.e. water damage from ski equipment on floors. Please use the provided space in the garage.
4.Please park in the designated parking area (main driveway, circle-drive, & 2 car garage)
5.No illegal activities
6.The home has a strict noise ordinance. Two complaints will result in the renter forfeiting the security deposit.
7.The home has a strict No Pet policy for any renters. No pet allowed pets.
8.No Direct TV purchases to be charged to account. You may purchase Pay-Per-View movies by calling and purchasing with your personal credit card. Purchases charged to the home account will result in the deduction from deposit.
9.Do not use any baseboard heaters. Feel free to adjust the Steffes heating units (1 located on each level; they are currently set at 65 degrees and can be raised to no more than 70 degrees).
10.Be respectful of the carpet and please remove shoes
11.Be cautious when using fireplace.
12.People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
13.Keep the property and all furnishings in good order.
14.Only use appliances for their intended uses.
15.Housekeeping: there is no daily housekeeping service. While linens and bath towels are provided, daily maid service is not included in the rental rate. This is not a hotel. One bath towel will be provided for each occupant unless other arrangements are made prior to arrival.

CHECK-OUT PROCEDURES

Trash- At the end of your stay, your responsibility is to empty trash from kitchen and bathrooms into the provided trash bags under the kitchen sink. Please put the trash into the garbage can located in the garage.
Dishwasher- Please put all dirty dishes into the dishwasher and begin a cleaning cycle when you leave.
Linens- Please strip the beds of linens and place them on the bathroom floor, along with any used towels.
Lights- Please turn off all lights when you depart.

We stayed recently with family of 12. Living room area nice but smaller for our group than we were hoping. Lovely home, very clean, nice scenery, close to town. Great hosts! Overall we definitly recommend.

Wonderful house on a gorgeous lot. Quiet and serene. Close to downtown, grocery store, restaurants and shops. Our family of nine was more than comfortable. I would recommend Breck's place to anyone!

An awesome cozy cabin getaway. We had a mini-family reunion and stayed in Breck's Cabin. Don't regret it at all. Would do again for sure.
