Guest agrees that no more than 10 PEOPLE and 3 CARS shall be permitted on the Leased Premises at any time during the lease term. Guest and their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall guest use the Leased Premises for any immoral, offensive or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the Leased Premises.
Cleaning Fees and Linens, Towels and Beach towels are included in the rental fee.
Guest shall keep the Leased Premises in a clean condition and shall leave the Leased Premises in the same general condition as found upon entry, including all pipes, wires, glass, plumbing and other equipment and fixtures. Guest shall be responsible for the proper storage and the final collection or ultimate disposal of all garbage. Trash bins are provided and trash pickup is twice weekly.
Repairs – Service Calls – Refunds: Guest agrees to rent property as is. There will be no refunds or relocation if guest is disappointed with the Rental Property. This property is unique and privately owned. The owner will make every reasonable effort to assure that the Rental property is in acceptable condition in regards to cleanliness and repair. Guest is required to inform owner of any visible damage or unacceptable cleanliness upon check-in within 24 hours of occupancy. The owner will make every effort to make any necessary repairs in a timely manner. No refunds or rate adjustments will be provided due to inoperable appliances, equipment, air conditioning, or mechanical failure of non-essential items such as TV, cable, washer/dryer, dishwasher, etc. Please report any inoperative equipment to the owner immediately. The owner will make every reasonable effort to have repairs done quickly and efficiently. Should a repair person be called to the Rental Property and find the equipment in working order or the problem was due to oversight or neglect, the charge for service will be the guest's responsibility. Also, no refunds will be given due to early departure, delayed arrival, reducing the number of nights, unfavorable weather, power blackouts, water shortage, flooding, or evacuation of the area due to hurricanes or potentially dangerous situations. Guest's reservation and signed Rental Agreement bind guest to this specific Rental Property for a specific period of time.
Indemnification and Hold Harmless: Guest agrees to indemnify and hold harmless owner from and against liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with guest's use and occupancy of the Rental Property including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred, or sustained by guest(s) and their guests.
Occupancy Requirements, House Parties, Right of Entry, Parking: Guest and guest's family shall not exceed the published occupancy and parking capacities of the Rental Property. On street parking is not permitted in this private neighborhood. The parking capacity in the driveway is three cars maximum. These limits are strictly enforced. Overcrowding is not permitted. In no event shall guest assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guest hereby acknowledges and grants specific permission to the owner to enter the premises at any time for inspection purposes should the owner reasonably believe that the owner is causing any damage to the Rental Property. Guest further agrees to grant the owner access to Rental Property for maintenance and repairs.
Pets: No animals or pets of any kind are allowed on premises unless specifically authorized by owner. The Damage Deposit Waiver does not cover any damage or flea infestation caused by a pet. Any undeclared pets found in or about the “no pet” property is grounds for immediate eviction and/or forfeiture of all monies paid and a non-declared pet charge of $200 per pet per day or any portion thereof at the owner's sole discretion.
Smoking: Smoking is strictly prohibited inside the Rental Property. Guest will incur an additional security deposit/damage waiver charge for additional cleaning and deodorizing if any evidence of smoking is found in the Rental Property.
Abuse of plumbing: Clogging of toilets will be the responsibility of the Guest. There is no garbage disposal on this property and any clogged pipes or damage to pipes caused by Guest misuse will be billed to the Guest's credit card on file or deducted from Guest's security deposit.
Telephone: Long distance calls should not be charged to the phone number of the telephone located within the Rental Property and are the sole responsibility of the guest. Any phone charges will be billed to guest or guest's credit card on file and guest hereby authorizes a charge to the credit card on file for any telephone charges incurred in violation of this paragraph.
Check-in and Check-out Policies/Cleaning Service: Guest acknowledges that Check-in time is 3:00PM or later on the beginning date of reservation, and Check Out time is no later than 10:00AM on the last date of the reservation. The guest's legal right to the use of the property does not begin until after the check-in time, and ends promptly at the check-out time. Guest is required to leave the Rental Property in the same general condition it was when TENANT arrived. Check In and Check Out times are not flexible and overstaying Check Out time may result in additional rent in the amount of $25.00 per half hour. An inspector will inspect the Rental Property after guest's departure to insure that the Rental Property is in good order, tidy, and damage-free. If, during the inspection, the inspector finds the rental property to be in an excessively unclean condition, or if the Check-Out Procedures are not met, a minimum of $25.00 will be retained from the guest's Security Deposit or billed to the guest's credit card.
Governing Law: This Agreement shall be enforced under the laws of the Commonwealth of Massachusetts and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Barnstable County, where the rental property is located. The owner shall conduct all activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any guest.
Guest acknowledges that they must furnish paper products during their rental period.
Guest agrees to accept the Leased Premises as is, upon arrival, provided it meets the basic standards of habitability under Massachusetts law. Guest acknowledges that he has had the opportunity to inspect the Leased Premises prior to executing this Lease Agreement. Guest agrees that he shall not be entitled to a refund of any Rental Fee except as provided in paragraph entitled, “Cancellation.” above.
Guest understands and agrees that it shall be guest's own obligation to insure guest's personal property.
Owner and guest state and agree that the rental of the Leased Premises is for a vacation or recreational purpose as expressed in Massachusetts General Laws C. 186, Section 15B (9).
The words "Owner" and "Guest" as used in this Lease Agreement shall include their respective heirs, successors, personal representatives and assigns. The words "he", "his", and "him", where applicable shall apply to Owner or Guest regardless of sex, number, corporate entity, trust or other body. If more than one party signs as owner or guest hereunder, the conditions and agreements herein of owner or guest shall be joint and several obligations of each such party.
The waiver of one breach of any term, condition, covenant, obligation, or agreement of this Lease Agreement shall not be considered to be a waiver of that or any other term, condition, covenant, obligation, or agreement or of any subsequent breach thereof.
If any provision of this Lease Agreement or portion of such provision or the application thereof to any person or circumstance is held invalid, the remainder of the Lease Agreement (or the remainder of such provision) and the application thereof to other persons or circumstances shall not be affected thereby.
