- Terms and Conditions of Temporary Holiday Accommodation: The guest is granted a limited permission to occupy the Property for holiday purposes. For the avoidance of doubt this is not a residential tenancy agreement under residential tenancy legislation. Failure to comply with the guest's obligations in the Terms and Conditions may result in termination of permission to occupy the Property and eviction. Payment constitutes the guest's acceptance of these Terms and Conditions. If the guest cancels or partially cancels the booking or causes the booking to be cancelled, money already paid is not refundable and monies which are overdue for payment can still be deducted by the owner unless the house is re-let for the entire period and for the same or a higher price as the original booking. However, even in the case of such re-letting a $100 cancellation and administration fee will apply. Depending on the nature of the booking a security bond of between $(PHONE NUMBER HIDDEN) to cover, losses, damages and other costs arising out of the occupancy is payable at any time from 7 days prior to arrival. This bond may be taken from the credit card supplied by the guest and will be refunded within 14 days of completion of the stay provided that the provisions of these Terms and Conditions have not been breached. Without prejudice to any other specific provisions of these Terms and Conditions, a failure to comply with the Terms and Conditions may result in charges against the security bond. The owner will use all reasonable endeavours to ensure the property is available as booked. However the owner reserves the right to make alterations to bookings due to unforeseen circumstances. Number of permitted Guests (i.e. the principal guest and his invitees) should not exceed the number stated on the confirmation notice at any time during the occupancy. Administration fees of $100 and total loss of bond will apply if there are excess guests not agreed with the Owners in advance. Guest is responsible for the actions and omissions of all of his/her invitees or visitors. Any visitors other than Guests are not permitted without the prior consent of the Owner. If any visitors are permitted then it is the obligation of the guests to control and be responsible for Visitors and ensure that Visitors comply with the House Rules. Parties and Functions are strictly prohibited. The price charged is for domestic use only and not commercial or business use. Accordingly the price does not include any extra costs associated with such use including but not restricted to cleaning, garbage removal, wear and tear and repairs. Without prejudice to any other remedies available the guest acknowledges that any use other than domestic use, unless otherwise agreed in advance in writing with the owners WILL result in loss of the security bond and/or additional costs arising from such use and guest authorizes the owner to revoke the security bond and/or debit any credit card used to make a principal payment in such circumstances. Damage, Breakages, Theft and Loss are the guest's responsibility during the occupancy. The guest shall be liable for all costs and expenses incurred as a result of such damage, breakages theft or loss howsoever caused or occurring. Without prejudice to any other remedies available, owner is authorized by the guest and shall be entitled to revoke the security bond to cover such costs and expenses and/or debit any credit card used to make the principal payment for any shortfall. It is mandatory that rubbish and recycling materials are left kerbside in the bins provided ready for collection on the night advised to the guest . If the bins are not put out then the client will be charged excess for their removal. The details of the timing of such collections are set out in the access details provided to the guest and shall form part of these Terms and Conditions. Any excess rubbish or recycling material which does not fit into the council bins provided is the responsibility of the guest and must be removed by the guest accordingly. If this is not done then rubbish and recycling material removal and tip fees will be charged for any excess AT $60 per bin and and guest authorizes the owner to debit any credit card used to make a principal payment in such circumstances. Guest must ensure that he/she and his/her invitees and visitors complies with any specific instructions regarding parking at the property but without prejudice to the foregoing must ensure that at no time do any of their vehicles block or hinder access to any public road or cause any inconvenience to neighbours or other road users. Departure - the property should be left in a similar state to its condition on arrival. If it is not then any costs and expenses associated with reinstating the property will be for the account of the guest. Prior to departure rubbish and recycling materials should be removed from the house and placed in the bins. If the BBQ has been used it must be left clean and if not a cleaning surcharge will apply. The owner arranges for a standard clean of the property as part of the price. However any non-standard or additional cleaning costs will be charged back to the guest at a rate of $40 per hour. Check-out time is 11am by the latest to allow time to prepare the property for the next guests, unless a late check out time has been agreed to with the owner. Check-in time is after 3pm. Any misrepresentation as the to number, make up or age of the group or unacceptable behaviour as determined by the owner and/or any disturbance whatsoever to neighbours, including excessive noise (which includes loud music, raised voices, car engines and foul language), is prohibited and may at owner's absolute discretion result in immediate termination of occupancy, forfeiture of all payments and loss of entire bond. Guests must not create noise which is offensive to neighbours especially between 10pm- 8am and during arrival and departure at any time throughout the occupancy. Guests must abide by any noise abatement conditions, standards and orders issued by police or any regulatory authority to minimise impacts upon the residential amenity of neighbours and local community. Linen (i.e. top and bottom sheets, pillow cases, bath mats and towels) is to be supplied by the guests. If there is evidence of any guest not using their own linen e.g. sleeping on uncovered mattress protectors, the property linen will be laundered and the cost deducted from the security bond at a rate of $45 per bed. Linen can be provided as part of the stay for an additional cost of $25 per single bed and $45 per queen or double bed. If a guest has any problems when arriving or during his or her occupancy he/she must advise Great Accommodation immediately so that these can be addressed at the time. Pets are allowed in some properties. However, persistent barking and/or howling is not acceptable and will be deemed to be excessive noise as referred to above. Pets must not be allowed on the furniture or on the beds and there will be additional cleaning charges for any cleaning necessitated by the presence of pets. The guest must also inspect the garden for any pet mess and clean this up prior to departure. The guest is required to bring bedding and bowls for pets. To the full extent permitted by law neither the owners nor its agents or agent's representatives shall be liable for any loss injury or damage (including loss of personal property) sustained by the guest or his/her invitees or visitors in the course of the stay and the guest and his/her invitees or visitors hereby release, discharge and/or indemnify the owner or its agents in respect of any such loss, injury or damage. It is recommended that the client take out travel insurance to provide protection against loss due to illness, injury, death, damage, loss or cancellation of stay. Neither the owner nor its representatives shall be responsible for any circumstance beyond its or their reasonable and foreseeable control. For the avoidance of doubt this agreement is between the guest and the owner. Great Accommodation and its representatives act solely as agents of the owner and are not principals to this agreement. Without prejudice to the specific provisions of these Terms and Conditions the consequences of not complying with the Terms and Conditions requirements can include enforcement action from the owner, owner's agent, security services, local councils or, where required, the Police. Such enforcement action could result in termination of permission to occupy the Property, eviction, loss of rental paid, deductions from security deposits and extra charges. The Terms and Conditions will be available at the property for reference and will constitute the House Rules. Other than with regard to the specifics of the occupancy in respect of matters such as but not restricted to the particulars of the guest and price and dates, these Terms and Conditions constitute the entire agreement between the guest and the owner and supersede all previous agreements and understanding, whether oral or written, between the parties with respect to the stay. They may only be varied by written agreement between the guest and the owner or the owner's agent. These Terms and Conditions are governed by and construed in accordance with the laws of Victoria, Australia. Any dispute not settled by negotiation shall be subject to the exclusive jurisdiction of the courts or tribunals of Victoria. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remaining provisions, which will continue in full force and effect.
