MUNICIPAL LAW No. 2.690, OF NOVEMBER 26, 2014
"Disciplines the emission of sounds and noises in the municipality of Mongaguá and makes other provisions."
Artur Parada Prócida, Mayor of the Resort of Mongaguá, using the powers conferred on him by law, makes it known that the City Council approved and I sanction and promulgate the following Law:
Art. 1 The emission of sounds and noises of any kind is limited by this Law, ensuring to the inhabitants of the Mongaguá Resort improvement of quality of life, the guarantee of tranquility, the right of neighborhood and environment balanced with the control of noise pollution.
Art. 2 It is forbidden to disturb the peace, public welfare and neighborhoods with sounds of any kind, exceeding 75 (seventy-five) levels of decibels within the Municipality of Mongaguá.
§ 1 From 10: 00 p.m. to 6: 00 a.m., the emission of noises, sounds and vibrations may not exceed 35 decibels (dB).
Art. 3 The disobedience or non-compliance with the provisions of this Law is considered an infraction, and the offender is subject to the following penalties, in the order listed below:
I - immediate notification to refrain from disturbing the order and quiet of others;
II - fine of 50 (fifty) UFESPS;
§ 1 In the absence of the order to stop the emission of sound or noise, regardless of the application of the fine, the Municipal Agent may request the assistance of the Municipal Guard, the Military Police and the Civil Police to comply with this Law, and the provisions of article 42 of Federal Law No. 3.688, of October 3, 1941 - Law on Criminal Misdemeanors and Federal Law No. 9605, of February 12, 1998, which provides for criminal and administrative sanctions derived from conduct and activities harmful to the environment.
§ 2 In case of recurrence, the fine shall be applied in double.
Art. 4 The result of the measurements shall be recorded in a specific report, which shall remain accessible to legitimate interested parties, and the copy may be delivered to the offender, at the time of the measurements, to be withdrawn at the City Hall, later.
§ 1 The sound or noise intensity levels shall comply with the established technical standards and shall be controlled by a sound intensity measuring device, in decibels.
§ 2 The measurements shall be made in accordance with technical instruction NBR 10.151 - issued by the Brazilian Association of Technical Standards - ABNT, or standards that may replace it and in accordance with Resolution No. 001, of March 8, 1990, of the National Council of the Environment - CONAMA and current federal norms.
Art. 5 The supervision of compliance with the provisions of this Law is the responsibility of the municipal authority, the public inspection agents, the Municipal Guard and other agents invested in the function.
§ 1 For the purposes of this law, the owner of the property in which the source of noise is installed is considered to be an offender.
§ 2 The fine will be applied in the real estate register of the property registered with the City Hall.
§ 3 In condominium units, when it was not possible to identify the unit responsible for the noise emission, the fine will be entered in the real estate registration of the condominium.
Art. 6 Any tourist and cultural event of the private or public initiative, which proposes to go beyond the decibels of article 2, shall require analysis by the City.
Art. 7 The City Hall shall carry out, whenever it deems convenient, inspections, in order to supervise compliance with the provisions of this Law.
Art. 8 The Head of the Executive Branch may edit the complementary rules necessary to comply with the provisions of this Law.
Art. 9 This Law enters into force on the date of its publication, revoking the provisions to the contrary.
