The space

Privacy galore. Eco-friendly. 24 panels on the roof generate all the electricity you can use and more. There is an evaporative cooler which uses half the electricity of air-conditioning and it's designed to be used with windows and doors open so you don't have to feel cut off from the outside. Or turn on the central AC if you like. The Cove has no street lights and the night sky dazzles with stars. There are several dining options within walking distance or downtown Palm Springs is just 12 miles away.

Parking for one large or two small vehicles under the carport inside the compound. Plenty of on-street parking. Driveway gate opens manually. Leave it open for convenience or close it for privacy and extra security. Pool is bordered with flagstone and the elevated spa cascades into pool. Heat the spa in minutes with a touch of a button for a relaxing end-of-day soak. Rinse off in the outdoor shower before heading inside.

Other things to note

While six is the maximum occupancy, the two small queen bedrooms share a small but charming bathroom with a shower stall that can only be accessed via either of the queen bedrooms. Taken together, the queen bedrooms form a master suite almost equal to the king suite so the house is perfect for two adult couples. Or a couple with up to four small kids. But 3 adult couples are allowed and there is plenty of comfortable common area for everyone to have a good time.

This house has louvered interior doors throughout. While the Master and Queen bedroom are on opposite ends of the house, if you desire absolute audible privacy, this house may not be for you.

Love the evaporative cooler for spring and fall. The cooler only works with doors or windows OPEN. So don't feel cooped up inside with sterile air-conditioned silence. Or use the AC, your choice.

Spa Heating is always free. Pool heat rates vary based on the month and your favorite temperature.

Fees (Stays Under 30 Nights)
All standard fees are determined in advance and clearly itemized on the Host’s partner web sites. Payment of any amount to the partner web site constitutes agreement to those fees.

Fees (Stays 30 Nights or More)
Fees and services might not be chargeable in advance. These typically include natural gas for pool heating, electricity for air conditioning, housekeeping, etc. The terms and conditions are season specific and an additional deposit amount may be requested. These fees and the methods used to calculate the fees must be negotiated in advance of booking via the on-line messaging system of the Host’s partner website used to book the stay.

AGREEMENT This Vacation Home Agreement is subject to all contract terms and conditions herein. Additionally, guest is subject to all terms and conditions specified on our partner web-sites that are not explicitly stated here. If any term or condition stated within the Agreement conflicts with those stated on our partner web sites, this Agreement takes precedence. This agreement is solely for the purpose of short-term vacation lodging. Residency is not offered or sought. Booking party attests that all information provided to our partner websites is true and correct. By paying all or a portion of the occupancy fee, Guest agrees to all terms and conditions set forth in this agreement and the House Manual. However, if all fees are not paid in full by the occupancy date, the Guest may not take occupancy of the vacation home and may forfeit all occupancy fees and TOT (transient occupancy tax) already paid.

Proof of Identity and Signatures and Minimum Age 25 Years Old
This agreement and the House Manual are posted to our partner websites. The booking process gives the guest the opportunity to review this agreement and the House Manual before clicking “I Agree” (or similar). Clicking “I Agree” means that guest agrees to all terms and conditions set forth in this agreement and on the partner web site. Additionally, for stays 30 days or longer, the Agreement must be signed by the responsible guest before check-in.
At least one guest must be 25 years old or more, provide a valid ID, and sign a registration card upon check-in. This guest will be the responsible party and may be liable for any damage not covered by deposit or damage insurance.
Occupancy will only be granted when the age, ID, and signature requirements are met. The occupancy fee and TOT will be forfeited if age, ID, and signature requirements are not met.

OCCASIONAL GUESTS: Guest agrees to notify Host via partner web-site or text or call to inform Host of any occasional overnight guests including pets not included in the guest count at booking. Guest agrees to pay occupancy charges associated with the occasional guests and their pets.

BOOKING UNDER 30 NIGHTS: Any additional occasional overnight guests including pets exceeding the guest count supplied at booking are charged at the standard additional guest rate.

BOOKING 30 NIGHTS OR MORE: Additional occasional overnight guests not including pets are allowed free of charge for stays of up to three nights consecutively. Occasional pets always incur the additional guest rate. Occasional guests staying longer than three nights consecutively are charged at the standard additional guest rate for the entire duration of the stay regardless of advance approval.

Guest Responsibilities & Terms & Conditions: This is a legally binding contract/agreement. Guest is responsible for payment, deposits and all facets and terms of the agreement. This agreement is a binding legal contract and must be construed as if both parties jointly wrote it, governed by California law. Guest’s signature on this Agreement, or payment of money or taking possession of the property after receipt of the Agreement, is evidence of Guest’s acceptance of the Agreement and Guest’s intent to use this property for a vacation home. Guest is legally responsible for all Guests & any others allowed onto Property, for their actions on the Vacation Property, and any loss and/or damage during and/or arising out of Term. Guest must first actually occupy Property in order to have and enforce any of Guests’ rights & privileges under this contract. Host has no limitation on enforcement of all contract provisions. Guest agrees any misrepresentation, incorrect information, and/or any contract or rules violation voids all right granted to Guest here under including occupancy – and all payments to Host are forfeited & any amount owed and/or any remainder shall go to Host as liquidated damages. The Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof.
Guest agrees to indemnify Carlson Peters and Ellen Peters, staff, and the Host/owner of said property for all liability, damage, personal injury, or loss to the Property or its contents that occur during Guest’s stay resulting from any cause, including but not limited to negligence, violation of any law, carelessness, neglect, theft or improper conduct of any persons entering, occupying or visiting the premises. Host is not responsible for personal items lost, stolen or left behind but will strive to return them to Guest via standard US Post at Guest’s expense. Occupant's or guests' personal property, including vehicles, are not insured by Owner or Owner's agent against loss or damage due to theft, fire, vandalism, rain, water, criminal or negligent acts of others or any other cause.

GOOD NEIGHBOR POLICY: This home is located in a quiet residential neighborhood and Host strictly enforces all applicable city ordinances that relate to occupancy, noise, age limits, and parking. Violation of Good Neighbor Policy may result in forfeiture of deposit.

GOOD NEIGHBOR POLICIES - IMPORTANT HOUSE RULES: Guest certifies that the responsible guest is 25 years of age or older and is also occupying the property and agree to honor the specified occupancy limits for this home (see page 1) and Guests’ conduct themselves in a manner respectful of neighbors by refraining from loud outdoor noises, disruptive parties, over-occupancy or any activity that interferes with the quiet enjoyment of neighbors, traffic flow, the community, and residents. the home in good order and appearance at all times and will not disturb, annoy, endanger or inconvenience neighbors or prompt written or verbal complaints to Casa Los Ladrillos from police, firefighters, or neighbors. No music should be audible from the property line. Quite time is 10PM to 10AM. Guests will be responsible for fines issued directly by city officials or police for good neighbor policy violations.

GOOD NEIGHBOR POLICIES – PARKING AND RVs Parking for one large car or two small cars are provided under the car port. Parking for additional vehicles is on-street in front of the house. Guest parking is limited to 3 overnight passenger vehicles total. Recreational vehicles, U-Haul type trucks and trailers, and large commercial trucks are not allowed due to parking constraints and local ordinance. Guests agree to use street parking directly in front of the home and avoid parking in front of other homes. Guest agrees to park in designated areas only. Guests agree to park at least six feet away from all mailboxes.

GOOD NEIGHBOR POLICIES – TRASH DISPOSAL Guests staying for more than one week agree to take trash bins out to the street on Monday night for trash pickup and remove them from the street by Tuesday evening. Guest agrees to place bins at least six feet from all mailboxes. If Guests are unable to perform this activity, Guests agrees to notify Host and allow Host or Host’s agents to perform this activity.

ACCELERATED EXPULSION - It is understood and agreed that any loud or large party, violations due to over-occupancy or violations of minimum age requirements of homes can result in immediate expulsion and forfeiture of all funds and entire security deposit. Host may expel Guest if Guest has damaged, altered, defaced, or vandalized the property. Host may expel Guest if Guest fails to take reasonable measures to secure the property when unoccupied.

CRIMINAL ACTS AND ILLEGAL ACTIVITY – Any criminal activities on the property will trigger ACCELLERATED EXPULSION.

DEFECTS AND REPAIRS AND CLEANLINESS AND REFUNDS - Host routinely performs due-diligence to ensure that the property's equipment, systems, appliances, pool-spa equipment, etc., are in proper working order and that the house is clean upon check-in. However, things do break sometimes. Housekeeping misses a spot once in a while. Guest must immediately bring any defect or malfunction or repair to the Host’s attention. Host will make all reasonable attempts to correct any defect. Guest must provide timely access for Host and his agent’s to remedy defects. If the defect makes the home un-safe or otherwise uninhabitable, Guest must immediately vacate the premises. Fair and reasonable compensation may only be made if the Guest immediately brings the issue to the Host’s attention and provides immediate access to remedy the situation. Maximum daily compensation is limited to the daily occupancy rate but in most cases will be much less. The compensation period begins starting at the time the defect is reported. The compensation period ends at the time the defect ends or at the regularly scheduled check-out, whichever is first.

NO REFUNDS NO CREDITS FOR: It is understood that in occupying a private vacation home or condo, there are many situations that are by nature beyond the control of the Host and credits or discounts will not be granted for such. Examples include, pool heating (pool heating fees may be refunded), TVs, radios, light bulbs, cable TV, Internet, phone, bed too hard or too soft, linens and towels not satisfactory, nearby construction, personal taste, bad weather, landscaping, neighborhood

disturbance/noise, clogged toilet, empty propane tank, washer or dryer breaking down, noisy leaf blowers. Expenses for unauthorized service calls are the responsibility of the Guest. There are no refunds or credits for defects brought to the Host’s attention after the guests check out.

CA LEASE LAW EXEMPT - Guest is not subject to any protections under the California or local laws governing long-term rental/lease agreements. This agreement is the only protection offered to the Guest. All occupants are guests, not tenants or renters. Guests are not residents of Casa de Los Ladrillos. This is not an offer of residency.

PETS: Up to two pets allowed only with advance permission through the Host’s partner website messaging system. Read the PET POLICY carefully. Failure to comply with the policy may result in accelerated expulsion.

PET POLICY
If a pet is brought without written permission, the security deposit is forfeited and accelerated expulsion applies.
Nightly per pet fee is the same as the nightly guest fee.
Guest must include pets in the guest count. Pets not included in the guest count will result in loss of security deposit and accelerated expulsion.
Pets count towards the maximum guest count. Exceeding the maximum guest count will result in loss of security deposit and accelerated expulsion.
Pets must be able to accompany Guest or be well behaved if left alone at the Vacation Home. Pets can’t be left in cars unattended! The Coachella Valley sun is very intense even on a winter day and interior temperatures in cars regularly top 100F. Police and concerned citizens do not hesitate to break a car window to release a pet from a hot car.
Pets must never be left unattended outside on the grounds of the Vacation Home.
Pet sheets are provided. Guests should cover any furniture or beds that the pet might sit or sleep on. Host launders all pet sheets between stays and stores them in a designated drawer.
Pet bowls, food, toys, beds, crates etc. are NOT provided. Guest must bring pet’s personal effects with them. None of the Host provided dishware can be used to feed or water pets.
Guest assumes full responsibility for pet safety, the safety of others, vendors, invitees and pet itself. As the Vacation Home has unscheduled visits by the pool cleaner and gardener, Guest assumes all responsibility for the safety of these and any other vendors that may need access to the grounds.
Host or Host’s vendors or agents are not liable for lost pets or responsible for finding them.
Pets should be up to date on all shots, be free of fleas and ticks, and otherwise be healthy.
Dogs must be licensed and wear the license on their collar.
Pet waste must be cleaned up daily by the guest. Shovel, rake, bags are provided. Extensive pet waste cleanup will result in a minimum $100 cleanup fee.
Pet damage, like any other type of damage, is charged against the security deposit.
An uncontrolled pet, incessant barking, or observed pet damage is grounds for accelerated expulsion.
Cathedral City is strict with their leash law. Dogs must always be leashed when off the Vacation Home grounds.

Commercial Photography: Commercial photography NOT permitted without prior expressed written consent of owner. Special insurance is required to be purchased by Guest for photography and film shoots including homeowner as additional insured.

NOTICE - POOL SAFETY RULES - ASSUMPTION OF RISK - RELEASE OF LIABILITY & INDEMNIFICATION Guests are responsible for pool safety of all other guests, children, pets, and guests’ invitees. Guest acknowledges that the safety of guests, children or pets depends on vigilance. The pool may be entered directly from several doors on the back side of the house. There is no separate pool fence and gate to control access from the house. There is no alarm on any door leading to pool area. Guest’s attentive personal supervision is absolutely required to avoid risk of serious injury and/or death. Pools and spas are serious safety risks & hazards - including injury or death - if not used with attentive care & caution. By signing this contract, Guests are aware of and assume the risk for any invitees during Guest’s stay. Host is not responsible for accidents. Guest agrees to indemnify and hold harmless from any and all liability (active or passive) Casa De Los Ladrillos, its owners, management or employees, the Host and/or property owners, from any harm or injury caused by using the pool and/or spa and equipment - or the Property specified by this contract. Guests hereby agree/accept that pools and spas contain necessary chemicals that can cause skin rashes, harm or discoloration of swimwear. Guests and invitees agree that use of pools and spas is completely at Guest’s risk. No lifeguard is on duty. No diving. No running. By booking this home via our on-line partners, Guests agree to honor all important pool safety guidelines:

* Child Safety. Never leave a child unsupervised near a pool, not even for a minute. During social gatherings at or near the pool, appoint a designated adult to protect young children from pool accidents. Children must be watched closely while swimming. Do not use flotation devices as a substitute for supervision. Toys and floats can entice young children into the pool area. When not in use, clear the pool area of toys.

* Pet Safety. Do not leave pets unattended near a pool. Pets can fall into the water and may experience difficulty getting out of the pool and drown.
* No Glassware. Do not use glassware in or near the pool or spa. Broken glass in pool area may result in additional charges. Plastic “glassware” is provided for use by the pool and spa.
* Pool/Spa Safety. Note that consuming alcoholic beverages and/or drugs and use of the spa can be dangerous and cause serious health risks. Avoid immersion in the spa for prolonged periods of time. * No Diving: The pool is five and a half feet deep in the deep end and is not suitable for diving of any sort. Diving into shallow water can cause serious injury, paralysis or death.

RELEASE OF LIABILITY - HOLD HARMLESS AGREEMENT Guest(s) shall indemnify and hold harmless Casa De Los Ladrillos, its employees, shareholders, and the Host / Property Owner, free and harmless from any and all liability, claims, loss, damages, demands or expenses, including counsel fees and costs, arising (a) by reason of the death or injury of any person, including Guest or any person who is a guest or invitee of Guest, or (b) by reason of damage to or destruction of any property, including property owned by Guest or any person who is a guest or invitee of Guest, caused or allegedly caused by (1) any cause whatsoever while that person or property is in or about the Property or in any way connected with the Property during Guest's occupancy; or (2) any matter connected with Guest's occupation and use of the Property.

POOL SERVICE: Pools/spas are cleaned on a twice weekly schedule on Mondays and Thursdays, generally between 10AM and 2PM. Pool man has access to the grounds but of course not the house.

Pool man does not announce himself at the front door but instead heads directly to the pool area. Pool service generally takes one half hour.

POOL HEATING: Pool heating is never free. When heating is ordered, pool is heated daily to a maximum temperature of 92F. The filter/heater are automated to run 8AM-5PM daily. However, the filter/heater only shut off once maximum temperature is achieved. Therefore, the pool will always achieve maximum temperature at least once per day. While the filter/heater are not running, the pool will cool down a bit. Pool heating charges always include the heat up period of about eight hours.

POOL HEATING (Stays Under 30 Days): Pool heating is never free. Heating charges are per night and must be paid in advance. Minimum term of pool heating is 3 nights (even if the Guest is only staying two nights). The Host does not guarantee that impromptu heat requests can be honored so plan in advance with Host. If Guest is unsure of their pool heating schedule, the policy for Stays 30 Day or More may be used if requested. The heating charge will vary depending on the season.

POOL HEATING (Stays 30 Days or More): Pool heating is never free. An additional utility deposit is required for natural gas to heat pool. The deposit will vary depending on the season. If heating is requested and a utility deposit is made, the pool remote control heat on/off button will be available to the Guest to turn pool heating on or off as desired. Actual gas usage will be determined based on daily usage as reported by the utility company on their My Account web site. Check-in day usage will be included and check-out day usage will be excluded. A credit for base usage (furnace, range, dryer) will be applied depending on the season. The actual gas rate per therm will be determined using the most recent utility bill available. The utility deposit and, if required, the damage deposit will be used to pay for pool heating after check-out. Daily usage and most recent utility bill will be made available to the Guest upon request. Unused deposit money may take up to 30 days to be returned to Guest.

GARDENING SERVICE: The grounds are blown and swept and spot-watered weekly on Monday 8AM. Host regrets the noise and disturbance of the leaf blowers but Guest acknowledges and accepts this disturbance is required to keep the property looking great. Gardener does not announce himself at the front door and has access to all the grounds. Gardening service takes about one hour.

CLEANING FEE: Once a guest takes occupancy of the home, the departure cleaning fee becomes non-refundable. Host requests that guests treat the home with care, leaving the Property in the same general condition as found upon arrival. If guests are not satisfied with cleaning, please contact our office within 24 hours so that Host can attend to Guest’s specific requests. No cleaning fees are refunded once the guest takes occupancy.

COOLING POLICY: During the summer and most of the spring and fall, cooling systems of one sort or another are generally required for comfortable living. The Host provides these systems at no charge. However, the Guest is responsible for minimizing the cost of this cooling.
Central AC is provided for use on hot and/or humid days. The Guest agrees to keep all doors and windows closed during operation of AC. Failure to comply with the closed house AC policy can result in full loss of damage deposit. Guest agrees to remote monitoring and control of AC thermostat by Host. Guests setting the AC lower than 76F are subject to an additional AC charge.

Ceiling fans are provided in all bedrooms for additional comfort. Their use is encouraged to keep costs down.

Evaporative cooling is provided for use during spring and fall and portions of the summer when the air is dry. The EC allows the Guest to leave some doors or windows open and more fully enjoy the desert. The AC must be off when the EC is on and vice versa. Guests are encouraged but not required to use EC instead of AC.

A wall AC unit in the kitchen is provided for additional cooling during the hottest portions of the summer to augment the central AC. This AC unit should only be used when guests are present in the kitchen area and should never be left on overnight.

HEATING POLICY: During the winter, heating systems of one sort or another are required for comfortable living. The Host provides these systems at no charge. However, it is the Guest’s responsibility to minimize the cost of heating and responsible operation of any of the heat systems.
Central heating is provided for use on cool days. CH is adequate to provide all heating needs. The Guest agrees to keep all doors and windows closed during operation of CH. Failure to comply with the closed house CH policy can result in full loss of damage deposit. Guest agrees to remote monitoring and control of CH thermostat by Host. Guests setting the CH higher than 76F are subject to an additional CH charge.

A fireplace is provided in the living room. Only Duraflame logs are approved for use. The Guest is responsible for procuring the Duraflame logs. Guest agrees to open flue and use fireplace screen and monitor the fire. An adult must light and monitor the fireplace until the fire is fully extinguished.

A gas torch is provided in the kitchen. Guest agrees to follow provided instructions for lighting and extinguishing the torch. An adult must light and monitor the torch until it is fully extinguished.

A chiminea is provided outside. Regular unpainted and untreated wood that fits into the chiminea without protruding can be used. The Guest is responsible for procuring wood. An adult must light and monitor the chiminea until the fire is fully extinguished.

"PEACE OF MIND" DAMAGE WAIVER FEE - COVERS ACCIDENTAL DAMAGE: Coverage for accidental damage may be purchased via our on-line partners during the booking process. The Damage Waiver Fee is a nonrefundable fee that relieves Guests of the cost for unintentional and incidental damage to the Vacation Home and its contents, subject to limits as documented within the policies themselves.

SECURITY DEPOSIT – The security deposit will be refunded according to the timelines set forth by our on-line partners during the booking process. Paying a deposit does not relieve the Guest(s) in any way from requirements stated in the agreement. Any damages, fines, or additional charges will be charged against the deposit, and charges exceeding the security deposit will be billed to the Guest and may result in a legal action or judgement if not paid promptly. Damage beyond wear and tear will result in a negative guest rating at the booking site. Follow the check-out procedure in this Agreement to assure a full refund of the security deposit.

Check-out check-list items are billed at $25/hour to perform by housekeeping staff. Lost keys are charged $50 each. Lost remotes controls for thermostats, TVs, and fans are charged $50 plus the actual replacement cost. Failure to secure the house is a $100 charge. Additional charges will apply for stains on carpets, furnishings, linens, or towels, excessively dirty ovens, stove-tops, or BBQ grills, dirty dishes, excessive trash & moved furniture or appliances or missing items. These are not normal cleaning and are not covered as part of the cleaning fee. Items requiring extra cleaning at departure will be deducted from the deposit at the rate of $25/hour. Other items requiring replacement are billed at their replacement cost including any delivery fees.

VACATION CANCELLATION INSURANCE: Vacation Cancellation Insurance is available from 3rd parties and our on-line booking partners. Vacation Cancellation Insurance reimburses for pre-paid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize Guest’s vacation investment and force Guest to incur unplanned expenses. Host strongly recommends Guest to purchase this valuable protection. If declined, Guest acknowledges they have read and understand Host’s cancellation policy and choose not to purchase Vacation Cancellation Insurance on behalf of all guests. Purchasing travel insurance is not required in order to purchase any products or services offered by Casa De Los Ladrillos.

GUEST CANCELLATIONS
Deposit, cleaning fee, and taxes are fully refunded if tenant does not take occupy of the unit. Other miscellaneous fees paid up-front like pool heating and occupancy tax may be refunded fully or partially on a case by case basis. In the event of an early departure, no occupancy fees or taxes are refundable.

FOR STAYS LESS THAN 30 NIGHTS: Cancellation policy stated on partner web site is in full force.

FOR STAYS 30 NIGHTS OR MORE: Cancellation policy herein overrides any conflicting policy stated on partner web site. Cancellations occurring more than 30 days before check-in forfeit 10% of the occupancy fee. Cancellations 30 days or less before check-in forfeit all occupancy fees paid at time of cancellation.

NO SMOKING: Smoking is not allowed in the vacation home. Smoking in this home will result in the forfeiture of security deposit and accelerated expulsion. Guests may smoke outdoors utilizing the many ash trays provided. Flicking butts on the ground is not permitted and will result in a $25 cleanup fee. While medicinal marijuana is legal in CA, it must be smoked outdoors.

HOST CANCELLATION AND SUBSTITUTIONS: Host strives to comply with all reservation requests for this property. However, if this home changes ownership, is withdrawn from vacation use, or experiences unforeseen mechanical or safety issues before check-in, Host may cancel the reservation without penalty at any time. Host will refund all reservation monies received from the Guest in these events. However, Host is not responsible for any ancillary Guest expenses such as pre-booked travel, planning, preparation, or lost income. Host will strive to assist in a search for alternate lodging. But it is ultimately the Guest’s responsibility to secure alternate lodging in these circumstances.

CHECK-IN & KEYS: Guest checks in directly to property. Guest is not permitted on the property prior to check-in. Early arrivals may be negotiated via e-mail, partner web-site, or text message. Guest will receive the detailed check-in instructions and property address only after final payment. It is the Guest’s responsibility to obtain directions and navigational instructions.

MAINTENANCE & SERVICE: Guest agrees to allow access at any time to perform services of an urgent nature. Guest agrees to allow access from 8AM to 6PM to perform maintenance and service of a non-urgent nature.

CHECK-OUT is 10 AM on the date of departure as specified on the partner web site through which payment was made. Late departures may be negotiated via e-mail, partner web-site, or text message. Unauthorized late departures will be charged an additional night. Please allocate time to perform Guest check-out duties by check-out time. Follow the check-out procedure and leave confident in the knowledge that the security deposit will be completely refunded. Take pictures or notify the Host of any unusual conditions or broken items so that the Host can remedy the issue before the next guest checks in. The check-out procedure is also listed in the House Manual for your convenience.
Using the pool remote, push the HEAT OFF button.
Load and run dishwasher. If you have more dirty dishes than fit in the dishwasher, wash them by hand.
Pots and pans should be cleaned and placed back in cabinets.
Wipe down counters, tables, and stove.
Clear all trash in bins and on floor, bag, and deposit in the outside trash bins near the gate.
Dispose or take any spoilable food in the refrigerator.
Leave the linens on the beds. Host will strip the beds and professionally wash the linens off-site.
Hang all used towels so they don’t mildew. Host will professionally wash all the towels off-site.
Turn off the Heat or AC.
Turn off Swamp Cooler. Both Pump and Fan should be in their off positions.
Turn off all lights.
Lock all doors and windows.
Place security bars on French windows and set the latches at the top and bottom of each door.
Place pool toys and floats in the storage bins.
Close the driveway gate behind you and latch it. If you are not tall enough to latch it closed, just latch it in the open position.
Drop the keys in the lower slot of the locked mailbox.

GOVERNING LAW, VENUE & TIME OF ESSENCE. This Agreement shall be governed by and construed in accordance with the laws of the State of California. Time is of the essence. Any legal action arising out of or relating to this Agreement shall be filed in a court of competent jurisdiction in Riverside County, Indio, California within 30 days of check-out.

WAIVER OF JURY. The parties agree to waive any and all right to a jury in any legal action between them arising out of or relating to this agreement.

ATTORNEYS FEES AND COSTS. The prevailing party in any action between the parties, including arbitration proceedings, arising out of or relating to this Agreement shall be entitled to recover his reasonable attorney fees and costs, up to an amount not to exceed $2500.00.

ENTIRE AGREEMENT. This agreement and the electronic messages exchanged between Host and Guest constitutes the complete agreement between Host and Guest and sets forth the obligations of the parties to each other. Any oral agreements or representations respecting the Property not expressly set forth in this instrument or the electronic messages exchanged are null and void. All prior negotiations between the parties are included in this agreement or electronic messages. This agreement may not be amended, modified, or changed, except as mutually agreed upon in writing or via electronic messages. The guest should retain the on-line booking confirmation and all e-mail correspondence as proof of any alterations to this agreement. Electronic messages only amend this agreement when both Host and Guest have acknowledged and agreed to the amendments electronically. A proposal to amend by one party requires acceptance by the other party before the amendment becomes effective. Failure to respond to a proposal to amend shall be interpreted as a rejection of the proposal.

SIGNATURES AND IDENTIFICATION
Proof of identity, proof of minimum age, and ink signatures on a registration sheet are required at check-in. This agreement is posted to our partner websites. The on-line booking process gives the guest the opportunity to review this Agreement, save it, and print it out before booking. Payment to Host’s partner website serves as an electronic signature. Clicking “I Agree” on Host’s partner web site means that guest agrees to all terms and conditions set forth in this Agreement and all terms and conditions set forth on the partner web site.
FOR STAYS LESS THAN 30 DAYS: An ink signature is not required on this Agreement.
FOR STAYS 30 DAYS OR LONGER: The responsible guest must also sign this agreement in the spaces provided below at the time of booking, initial all pages, and return to the Host in a timely manner. Failure to provide a signature on the Agreement will result in cancellation of the reservation. Signed agreement may be provided via e-mail or US Post.

Carlson was a very good host and showed us around the house when we arrived which was helpful. The house is lovely and very unique which made it feel even more of a holiday! It is in a good area with easy access to the whole valley and a lovely pool.

The adobe getaway was a dream! Spacious, relaxing, airy and the perfect private oasis. We LOVED the pool and spa, two outdoor lounging areas (shade or sun) and slept SO well. The house stayed cool with the evaporative cooler, it was incredibly clean and the kitchen was very well appointed. We are already looking at dates to return next year when we can stay here again. Thank you for a marvelous stay!
