Great location -- 100 feet of private lakefront on Lake Champlain, on a 1+ acre lot. 40 foot wraparound deck. 2 bedrooms and third loft bedroom. well appointed kitchen, dining area/living room. Free wifi. Washer/dryer in walk out basement.
We have just redone the bathroom and built a deck for the outside shower.
The parties hereto further agree as follows:
1.This is a weekly furnished summer rental. Landlord makes no warranties or representations about conditions of beachfront or property or accessories.
2.NO CANCELLATIONS WILL BE ALLOWED AFTER MAY 1, 2016.
3.Tenant my not sublet the premises under any circumstances.
4.The premises shall be used as a private dwelling only by the tenant, tenant’s family and non-paying guests. No business use is permitted. Tenant shall not keep any pets without written consent of landlord which in no event shall be given for any cats, rabbits, reptiles or large dogs.
5.Tenant acknowledges that the premises are located on the shore of Lake Champlain. Tenant acknowledges that it is tenant’s duty to ensure the safety of all tenant’s family, guests and pets that may be at the premises. Tenant acknowledges that he/she is familiar with water safety rules and coast guard rules. Landlord makes no warranties or representations about conditions of watercraft, mooring, dock or raft which may be available. Tenant acknowledges that said watercraft, mooring, dock or raft is left as an accommodation for Tenant. Tenant will personally check any watercraft, mooring, dock and raft for their fitness and use. If tenant allows tenant, family, pets or guests to use said watercraft, mooring, dock or raft then tenant accepts responsibility for any injuries to tenant, tenant’ family, pets and guests.
6.Tenant agrees that no person or child may go out in any watercraft provided by landlord without wearing a life vest.
7.Tenant agrees that all watercraft shall be left up on the grass at the end of tenant’s rental.
8.Landlord shall not be responsible for (a) any loss or damage to tenant’s contents, (b) any injury, loss or damage for which tenant is liable, or (c) any injury, loss or damage suffered by tenant’s guests, employees, invitees etc. unless caused by Landlord’s gross negligence. Landlord shall not be liable for injury or damage to tenant or any other person who uses or is on the premises or be liable for damage to their property unless the same results from landlord’s gross negligence. Tenant is responsible for all acts of tenant’s family, employees, and persons tenants invites unto the premises and shall hold landlord harmless for same. Tenant must pay for damages suffered and money spent by landlord relating to any claim arising from any act of negligence by Tenant.
9.No more than seven 7 people may stay overnight at premises. Due to septic system concerns no more than 10 people may be on premises including the land at any time. No more than 10 people may be on the deck at any time. No more than 7 people may be on the dock at any time.
10.No diving is permitted from the dock.
11.No furniture or household items are to be moved from the house to the outside. No furniture, pictures, artwork, may be moved, stored or the like. Tenant must not alter, decorate the premises, including, but not limited to, painting.
12.Items in the basement, with the exception of the washer and dryer are not available for tenant’s use.
13.Items in the locked closet in the loft are not available for tenant’s use.
14.Landlord has given or may give written instructions about the care or use of appliances, equipment or other personal property on the premises. Tenant shall follow those instructions.
15.In the event that any service is not available, due to conditions beyond landlord’s control, for example an electric outage, landlord shall not be liable and there will be no apportionment of rent.
