Terms and Conditions for booking through Sunrise at 1770 Holidays
This is an agreement between the Holiday Letting agents for Ocean Ridge Enterprises Pty Ltd Trading as Sunrise at 1770 Holidays and the tenants/ guests as lessee of the defined holiday remises. By booking a holiday rental property with Sunrise at 1770 Holidays and paying the rental deposit, you agree that you will be bound by, and personally responsible for performance of your obligations under these conditions of letting.
1.BOOKINGS: The minimum stay is 3 nights. Weekly bookings may be required during QLD School Holidays, Easter and Christmas Holidays (December and January).
2.DEPOSIT: Please be advised that a 2.0% credit card surcharge applies on all credit card payments when entering into any transaction with Ocean Ridge Enterprises Pty Ltd T/A Sunrise at 1770 Holidays.
3.HOLIDAY RENT: Total rent must be paid 1 calendar month prior to arrival. For Christmas and Easter bookings total rent must be paid 2 calendar months in advance. Unless otherwise advised by you, we will deduct the balance from the credit card provided on the due date. Access details and keys will not be provided until the security bond + full rental costs for the booking have been paid.
4.SECURITY BOND: A security bond is required to be held in Trust for all bookings. A security bond of $1500.00 is required via credit card and must be processed at least 2 weeks prior to your check in. Valid credit card details must be provided prior to your arrival, signing the guest registration form pre-approves this amount to be deducted. The security bond is automatically released following a departure inspection, and subject to the further conditions in this agreement, provided the premises are left in the same condition as at the start of the booking. The guests authorise Sunrise at 1770 Holidays to pay or reimburse itself or the owner of the property from the bond provided for any cost or expense, damage, breakage or other loss applicable to or arising out of the use and occupation of the Property pursuant to this reservation (Including but not limited to telephone charges, hire and cleaning charges, the repair and/or reinstatement of the property) and any cost or expense incurred due to the breach of these Terms and Conditions (including but not limited to any charges incurred with or by Sunrise at 1770 Holidays, Police, Fire or other emergency services or security personnel) and any additional Tariff payable by the Guests. If the amount of the bond provided is insufficient to pay or reimburse the whole of the cost or expense and/or additional Tariff to Sunrise at 1770 Holidays or the Owner of the Property, the Guests acknowledge their joint and several liabilities to pay to or reimburse Sunrise at 1770 Holidays, The Sunrise at 1770 Body Corporate or the Owner of the Property for any outstanding cost or expense. The bond refund should take 5-7 business days to reappear into your account.
5.CANCELLATIONS: Low season: if amendments are required prior to 1 calendar month of arrival we can shift your dates no charge. Cancellations made prior to 1 calendar month of arrival incur a $100 cancellation fee. Cancellations made within one month of arrival forfeit all funds paid. Peak season (school holidays): if amendments are made prior to 2 months of arrival we will happily do so at no charge. Cancellations made prior to 2 calendar months of arrival incur a $100 cancellation fee. Cancellations made within 2 calendar months of arrival forfeit all funds paid. In the rare event that our two access roads into Agnes Water are flooded we will be more than happy to hold your booking to use within the following calendar year at your requested dates subject to availability. Re-booking is not valid at Easter or Christmas. We suggest travel insurance. Cancellations must be made in writing by the person who made the reservation. For whatever reason you decide to depart prior to your departure date, we do not refund rental costs either in full or part thereof. No provision can or will be made for relocation if accommodation is deemed unsatisfactory on arrival other than on the basis that the full rental due be forfeited and full rental on new premises is paid prior to occupancy. Guests must accept premises as booked and cannot be relocated. We are careful not to misinterpret any rental property; no refund is given if you are not satisfied with your accommodation.
6.ARRIVAL AND DEPARTURE: Holiday premises are available from 2:00pm on the day of arrival and are to be vacated no later than 10:00am on the day of departure. Upon check-in, the named Guests must sign a Guest Registration Form, pay any balance Tariff and provide a signed credit card authority. Please be sure to have photo identification and your credit card ready. Please be aware that if you do not check out by 10:00am a late checkout fee of $50 per hour will be deducted from your bond or charged to your credit card. Subject to availability, a late checkout may be arranged on arrival. The charge of $50 per hour is until 12pm noon, late check out after midday is an additional night's tariff. Keys may be collected from the office of Sunrise at 1770 Holidays within the Springs Road compound, located on the right just prior to reaching the Sunrise at 1770 Entrance roundabout. Key collection is arranged through contact with Rebecca on (PHONE NUMBER HIDDEN). Keys should be returned to the agent immediately upon departure. All guests must ensure the property is secured properly on departure of the premises.
(URL HIDDEN) In accordance with Sunrise at 1770 Body Corporate By Laws, animals along with any other exotic species are forbidden within the Sunrise at 1770 Estate. This includes pets within vehicles. If animals are found to be within the Sunrise at 1770 Estate, guests will be asked to vacate immediately and a fine of $1,500.00 will be payable.
8.NUMBER OF PERSONS: The property is rented on the basis that it accommodates only the number of persons specified. Additional occupants will be asked to leave or additional charges may be payable, which, at the sole discretion of Sunrise at 1770 Holidays, may be deducted from the security bond. Additional infants who do not require a bed must have pre-approval and guests are responsible for their own porta-cot + bedding. Day visitors are permitted however must depart the estate prior to 5pm. Day visitors are not permitted to use the communal pool and BBQ pavilions during peak season.
9.SCHOOLIES: In accordance with Owner's wishes, absolutely no Schoolies are permitted within the Sunrise at 1770 Estate. Bookings will only be taken by guests over the age of 18 years old.
10.USE OF PROPERTY: The Property is to be used strictly as a residential dwelling for residential purposes by the Guests and the number of occupants nominated on the Guest Registration form. The Property is not to be used for any other purpose or by any greater number of occupants than that nominated at the time of booking. The use of the Property for a function, a party, a group gathering, wedding ceremony, wedding reception or any other functions, gatherings etc is STRICTLY PROHIBITED. Should it come to our attention that a booking has been made other than for accommodation purposes or if you use the Property for a function, or party with noise violations
- Your reservation of the property will be terminated immediately
- The Guest and all other occupants of the Property will be evicted and removed from the estate
- Additional charges may be payable, which at the sole discretion of Sunrise at 1770 Holidays, may be deducted from the security bond
- The Guests agrees to pay an additional Tariff of $4,400.00 (including GST) and authorise Sunrise at 1770 Holidays to debit that additional Tariff to the credit card(s) provided.
Neither the whole, nor any part of the property shall be sub-let without the written consent of Sunrise at 1770 Holidays.
11.NOISE: No noise or behaviour unacceptable to neighbours 24/7. Noise means any sound that can be heard from neighbouring properties that disturbs their peace and quiet. To ensure quiet enjoyment of others, noise should be kept within reasonable levels. If noise is excessive and security services or the police need to be called then a call out fee of $165 will be charged. If two or more call outs for noise or rowdy behaviour are made, there is a callout fee for each callout, and then the booking will be terminated. If a booking is terminated in accordance with the provisions of this clause, no refund of rent or security deposit will be given, and you agree that any such rent or bond withheld is genuine compensation for loss occasioned by you. You agree to abide by any noise abatement order issued by management, the Police, Security personnel or any other authority.
12.DESCRIPTION OF THE PROPERTY: The Property is on the Internet for marketing purposes. We give this description in good faith as agents of the principal and owner. We are careful not to misrepresent any rental property; if you are not happy with the property we will do our best to remedy the problem if possible. If for whatever reason you choose to depart prior to your departure date, we do not refund rental costs either in full or part thereof. All accommodation is fully furnished and includes kitchen facilities. Changes to the property grounds and/or surrounds, outside of our control, such as weather, erosion, council work, maintenance and neighbouring reservations/construction will not affect the quoted tariff. We will advise you of these changes prior to your stay where foreseen. We will not refund any costs either in full or part thereof. Linen is only provided where stipulated in the property description; otherwise linen may be hired locally. The agent expressly excludes any liability whatsoever for any misrepresentation, or misleading conduct or statements, howsoever caused, and whether negligent or otherwise.
13.FURNISHINGS AND LINEN: Linen is only provided where stipulated in the property description, otherwise linen may be hired from Sunrise at 1770 Holidays.
14.DAMAGES AND EXTRA CLEANING: The premises and grounds are to be left in a clean and tidy condition. Please ensure dishes, pots and pans etc are washed and put back into cupboards, rubbish bagged and put in rubbish bins provided, BBQs cleaned etc. Failure to do so will incur a charge for extra cleaning which will be deducted from your security deposit. If BBQ is provided, a cleaning fee of $50 will apply if not left clean. All breakages, damages and lost keys must be reported to the agent and paid for by the tenant. Furniture and furnishings are not to be rearranged and must be in original position on departure. If washing up, tidying, re-arranging of furniture and removal of excess rubbish has not been done, fees for extra cleaning will apply. Charges for professional cleaning of carpets after a guest stay, any excess cleaning requirements from odours and damage relating to smoking inside and/or around the property during tenancy, excess marks on walls and glass. All damages, breakages, extra cleaning, labour and staff costs for processing bond claims will be deducted from the Security Bond before it is refunded, or deducted from your credit card. Should the amount of loss or damage exceed the amount of the security bond, we reserve the right to claim the full costs of reparation from you. Nothing in this agreement is to be taken to limit our rights to make this claim.
15. SMOKING: All homes let through Sunrise at 1770 Holidays are Smoke Free Homes. No smoking is permitted on the site of the dwelling, including balconies etc. Smokers please utilize communal areas within the estate to light up. This eco-estate is subject to a total fire ban so it is imperative that all butts are extinguished properly and disposed of responsibly into bins provided. Guests found to be smoking on the site of the dwelling will be subject to extra costs for cleaning and deodorization.
16.ADVANCE BOOKINGS: Sunrise at 1770 Holidays can take bookings 12 months in advance. The rental deposit is due as usual within 24 hours.
17.BREACHES: Any breach of this agreement by you permits us to refuse the key, amend the rent of the premises or immediately terminate the tenancy at our sole discretion.
18.SALE: In the event the property is offered for sale, the tenant agrees to allow the owner or the agent to inspect the property with prospective purchasers, provided that reasonable notice of an appointment is given. 24 Hours is deemed reasonable notice. The agent accepts no liability should a property be sold and the booking cancelled. In this event all reasonable endeavours to find alternative accommodation will be made by the agent.
19.INSPECTIONS DURING YOUR STAY: During your stay, a staff member of Sunrise at 1770 may require access to the property to carry out an inspection for maintenance and repairs or if the property is for sale to show prospective buyers. All attempts will be made to reschedule these inspections for when the property is vacant. However, if these cannot be rescheduled, we will give prior notice and arrange a suitable time with you. 24 hours is deemed reasonable notice.
20.UNFORSEEN CHANGES: In the event of the premises becoming unavailable to the tenant through unforeseen circumstances then the agent will inform the tenant immediately and endeavour to obtain suitable alternative premises, failing which all monies paid will be refunded in full to the tenant. The tenant will not hold the agent or owner responsible should any unforeseen event occur and if no suitable alternative premises can be found, the agent accepts no liability whatsoever in this regard.
21.KEYS: A call out fee of $80.00 applies for misplaced keys or after hour callout being outside the hours of 8:30am – 5pm. If any restricted master keys are lost or misplaced, all locks for that property must be changed at a cost within the vicinity of $150 to $800.00 to the holiday guest. If your keys are misplaced please call us ASAP on (PHONE NUMBER HIDDEN). All guests are to maintain the security of the property at all times.
22.REPAIRS TO APPLIANCES: During your stay, the agent endeavours to have repairs to appliances attended to as soon as possible after being reported. However due to circumstances beyond our control (e.g. having to order parts or non-availability of tradespeople) immediate repair may not be possible. No responsibility is accepted by the agent or owner in such circumstances. There will be no refunds or discounts deducted from tariffs for unusable appliances awaiting repair. If repairs cannot be attended to promptly, we will use our best endeavours to supply a substitute appliance if possible.
23.BODY CORPORATE BY LAWS AND REEDY CREEK CONSERVATION MANAGEMENT PLAN: The guests and all other occupants and visitors of the property will comply with any Body Corporate by-laws and rules applicable to the Property or which regulate the behaviour of occupants of the property. The Guests and all other occupants and visitors of the property will not create or permit any noise or other nuisance to occur within or emanate from the Property. No pets or exotic species permitted, a total fire ban and no functions are other by-laws that must be complied with. Please refer to the “Sunrise at 1770 Body Corporate House Rules" below.
24.FORCE MAJEURE: If circumstances beyond the control of Sunrise at 1770 Holidays affect this reservations (such as flood, fire, act of God, war or threat of war, physical unrest, riots, civil disturbances, terrorist activities (threatened or actual), strikes, port or airport closure, technical problems with transport, alteration or cancellation of scheduled travel services) then Sunrise at 1770 Holidays may, at its discretion, cancel this reservation and offer either a)alternative accommodation or b) a proportional refund of monies paid by the Guest or c) hold the booking to use at a later date.
25.INSURANCE: Sunrise at 1770 Holidays recommends that the guest obtains travel insurance to insure against the loss of deposit, cancellation charges, medical expenses and loss of personal belongings, delays or natural disaster and any other foreseeable loss or expense.
26.RESPECT & PRESERVE AMENITIY OF PROPERTY AND ESTATE: Sunrise at 1770 is an eco-estate with a focus on relaxation and quiet appreciation of the natural surrounds. Engaging in drunken, obscene or antisocial behaviour that affects the experience of other guests, tenants and residents is not tolerated and will result in immediate eviction by the on-site manager.
27.COMPLAINTS: In the event you have a problem or a complaint, it is imperitive that you inform Sunrise at 1770 Holidays at the earliest opportunity so that we can rectify the situation as quickly and efficiently as possible. Complaints made on departure about un-reported issues that could have been rectified during the stay will not result in any refund or reimbursement. Any complaint which cannot be resolved locally must be notified in writing to Sunrise at 1770 Holidays within 3 days of the end of the service provide. If you fail to follow this procedure this may hinder the ability of Sunrise at 1770 Holidays to rectify the complaint and reduce or extinguish any claim the client may have.
28.GOVERNING LAWS: The Law of QLD governs your use and occupation of the Property during this reservation. You agree to submit to the exclusive jurisdiction of the Courts of QLD.
SUNRISE AT 1770 BODY CORPORATE HOUSE RULES
Sunrise at 1770 Body Corporate welcomes you and hopes your stay is an enjoyable one. The complex occupies land in an environmentally significant setting and as such the body corporate encourages you to enjoy the facilities provided whilst respecting the land, other guests and residents within the property.
Please observe the following House Rules which is provided to help you with your stay.
•Loud music or anti-social behaviour will not be tolerated
•Contact your Letting Agent regarding any issues with the house
•Your visitors are welcome to enter the complex or use the facilities but must be accompanied by you at all times
BODY CORPORATE FACILITIES
Both the Springs & China Beach Clubs have 4 BBQ pavilions and 25 metre pools. A kid's pool is located at the Springs Club
BBQ's & Pavilions
•Please fill out the register located at each BBQ pavilion
•BBQ's and Pavilions are to be cleaned thoroughly after use and left in a clean and tidy state for the next user
•Cleaning equipment is provided and stored in cupboard under sink.
•Please ensure that BBQ's and lights are turned before leaving
•Place all rubbish in the bins provided.
•Excessive noise and anti-social behaviour is not permitted.
•Please respect others when using club facilities.
•First aid kits & emergency phones are situated at entrances to toilet facilities at both clubs.
•Bombing, jumping & diving into pools is not permitted
•Children are to be supervised at all times
•Toddlers are to wear water proof nappies.
•Please lower umbrellas after use. Do not raise during excessive wind conditions
•When finished with tennis court please loosen net and sweep court with broom
•Children are not permitted to ride bikes, scooters or skateboards over courts.
•Children are to be supervised at all times
Toilets & Showers
•Children are to be supervised when using toilet & shower facilities
•To conserve water please avoid lengthy showers
•A 30km/h speed limit applies to vehicles throughout the property. Speeding will not be tolerated
•There are several steep gradients which require drivers to traverse at a slow & safe speed.
•Sections of the road system are widened to allow oncoming traffic to pass safely and to avoid driving over kerbside. Please make an effort to use these sections correctly.
•Pedestrians & cyclists have right of way.
•Be aware children and workmen when driving within the estate. Slow to a safe speed when approaching & passing.
•Parking of vehicles must be within the boundaries of the rental property
•Please separate your waste into appropriate bins
•Bin removal is 6.00AM (SHARP) Monday mornings. Place bins on kerbside.
•Recycled bin collection is every second Monday
•If bin removal time is missed a charge will apply for bin removal if requested.
•A 20 litre bucket is provided for food scraps which is part of the sustainable objective of the complex
•Separating food scraps from general rubbish also prevents unpleasant smells and flies
•Place bucket alongside bins
•Domesticated animals are not permitted anywhere within the development which includes animals confined to vehicles
•Outdoor fires and wood fired BBQ's are not permitted
CHECK OUT TIME
•Holiday guests must depart the property immediately after the check out time of the rental home. Relocating to the Body Corporate facilities after check out is not permitted.
