The short of it, please keep the house orderly & clean and be respectful to the neighbors.
The lengthy version:
1. SECURITY DEPOSIT. Tenant agrees to be responsible for any and all damages that are caused by Tenant and within Tenant's control to Property, its contents, and grounds during the tenancy period, If there are problems with the Property as a result of Tenant's actions or inactions, a full accounting will be made to Tenant, and an amount necessary to cover the problems will be deducted from the Security Deposit, or billed to the tenant. The security deposit will be mailed back to you, or refunded to the credit card via PayPal, within 2 weeks of check-out as long as everything has been returned in the same order as when it was rented. Receipts will be given to tenant to confirm the repairs made. If more repairs are needed beyond the amount of the security deposit the tenant will immediately submit monies due.
3.CHANGES TO PROPERTY: Tenant shall not make any material or structural alterations to the Property without Owners written consent.
4.SMOKE DETECTORS. Tenant is required to check all smoke detectors upon check-in and promptly report inoperative smoke detectors to Owner.
5.PROPERTY INSPECTIONS. All problems, including inadequate cleaning and damages must be reported in writing to Owner within twenty-four (24) hours of check-in in order for prior guests to be held responsible. Owner reserves the right to enter premises at any time for the purpose of effecting necessary inspections, repairs, or maintenance.
6.CHECK-IN TIME. Check-In time is on the arrival date anytime after 3pm. Arrangements can be made if you need to drop off your luggage prior to check-in time. Inquire with Lori ahead of time to get approval and confirmation.
7.CHECK-OUT TIME. Check-Out time is on the departure date no later than 11am. Tenant must notify Owner in advance of a late check-out. Upon vacating the premises, please make sure all doors and windows are locked, heating units are turned off, and any borrowed items are cleaned an put away.
8.OCCUPANCY. The maximum number of occupants allowed to reside in the Property is 10 (10), unless prior written arrangements are made with Owner and it is documented on the contract (each additional person is $10/person per day). Children, including babies of all ages, are counted in this number. Overcrowding or misrepresentation is grounds for immediate eviction without refund. The only people allowed to be present in the house are the guests on the contract, any additional people present in the house without prior written permission and acknowledgement by the owner is grounds for eviction and complete loss of deposit.
9.RESTRICTIONS ON PROPERTY USE. Tenant and occupants are prohibited from engaging in any unlawful activity or other activity that constitutes a nuisance. Parties are strictly forbidden, along with loud music, or excessive traffic in or around the unit.
a.The house is in a neighborhood and "Quiet Times" are expected. Home is to be quiet by 10:00 pm nightly.
b.If neighbors contact the owner about noise the tenants may be subject to losing their deposit.
10.PETS. (Prior approval and Pet Rental/Deposit Required)
11.SMOKING 100% PROHIBITED ANYWHERE ON PREMESIS. The Property is a “no smoking" household. Smoking includes, but is not limited to, cigarettes, pipes, cigars, and any other form of inhaled substance. NO SMOKING ANYWHERE ON PROPERTY, EVIDENCE OF SMOKING WILL RESULT IN AN IMMEDIATE LOSS OF THE FULL DEPOSIT AMOUNT.
12.ANTS & INSECTS. Tenants/occupants are solely responsible for exterminating any ants, flies, spiders and/or other bugs that find their way into the home during your stay. It is extremely important to immediately clean up in the home as the ants will find their way in and munch on anything that is left behind within minutes.
13.PERSONAL PROPERTY LOSS. Tenants/occupants are solely responsible for personal property left in or about the Property, and Owner shall not be liable under any circumstances for damages to, or loss of any property.
14.PHONE. There is no land line or “house phone".
15.PROPERTY USE. Unit may not be used for any activity in violation of local, state, or federal laws, or California Insurance rules and regulations. May not be used to film anything for commercial or professional production use without additional location permit and additional funds to be used as a location fee for any video or film. Need an additional contract and approval for such use.
16.ATTORNEYS FEES. If Owner employs legal counsel or a professional collection service for collecting any amounts due to the Owner under this Agreement, Tenant shall be responsible for all costs of litigation and collection, including reasonable attorney's fees. In the event of any action or proceeding commenced by any party, the prevailing party in such action or proceeding shall be entitled to recover from the other party all costs and expenses thereof, including reasonable attorney's fees and costs.
17.LIMITATIONS ON RENTAL Owner will not be liable for circumstances beyond its control, including but not limited to; appliances or heating failure, other mechanical failure, unfavorable weather, disruption of utility services including cable television, any television/stereo or home theater defects, etc. There will be no relocation, rental rate pro-ration or refund in the event of such circumstance, or for displeasure with unit or surroundings. In the event Owner is unable to deliver said Property to Tenant under the Agreement because of property sale, property fire, mandatory evacuation, eminent domain, faulty maintenance, or “Act of Nature", or if the property is unavailable because of construction delays or because of lack of utilities, Tenant agrees that Owner's sole liability, as a result of any of these conditions, will be limited to full refund of all payments tendered by Tenant.
18.INDEMNIFICATION. Tenant agrees to release and indemnify Owner from and against all liability should anyone be injured upon the premises during the term of occupancy, resulting from any cause whatsoever (including hot tub injuries), except in the case of personal injury caused by willful gross negligence on the part of the Owner.
19.OWNER CHANGES. Every effort is made to ensure ail information on our website is accurate and complete. Owner is not liable for typographical errors, omissions, price changes, and any other changes by the Owner in furnishings, type of equipment, bed arrangements, and other accommodations.
20.EFFECTIVE DATE. Notwithstanding any other assurance to the contrary, this Occupancy Agreement is not binding or effective until Owner receives a confirmed Reservation Deposit.
21.GOVERNING LAW. The terms and conditions stated herein will be interpreted by and governed under the laws of the State of California, and any action arising out of this agreement shall be litigated in the City of San Diego, State of California.
22.INVALID PROVISIONS. If any provision of the Agreement is held to be illegal, invalid, or unenforceable under present or future laws effective during the term hereof, such provision shall be fully servable and this Agreement shall be construed and enforced as if such illegal, invalid, or unenforceable provision had never comprised a part hereof, and the remaining provisions hereof shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision or by its severance hereof.
23.ENTIRE AGREEMENT. This Agreement set forth the entire understanding of the Owner and Tenant, and supersedes all prior agreements or understanding, whether written or oral, with respect to the subject matter hereof. No amendment or modification hereto shall be binding unless made in writing and signed by the Owner and Tenant hereto.
24.BINDING EFFECT. This Agreement shall extend to and be binding upon and inure to the benefit of the Owner and Tenant hereto, their respective heirs, representatives, successors and permitted assigns; however, Tenant may not assign this Agreement.
25.WAIVER. The waiver by either Owner and Tenant of a breach of any term or provision of this Agreement shall not operate or be construed as a waiver of a subsequent breach of the same provision by Owner and Tenant or of the breach of any other term or provisions of the Agreement.
26.LAUNDRY. A washer & dryer will be available. Due to the water restrictions implemented in San Diego, please limit usage, and only wash items that ABSOLUTELY need to be cleaned before you return home. We ask you to launder any beach towels you use and put them away prior to your departure. The cleaning service will launder the sheets and bath towels. Laundry soap will need to be purchased to do your laundry.
27.TRASH. It is the Tenant's responsibility to make sure the trash is taken to the curb and returned the same day after being emptied on the trash removal days. Refer to "other things to note" on the trash days.
28.WATER. San Diego is experiencing a major water shortage and homes are to ration water at all costs, therefore, it is imperative that all guests take showers that are 5 minutes or less and do everything in their power to not waste water in any way during their stay.
29.PARKING. You may park your vehicles in the driveway or on the street in front of the house.
30. PAYMENT. Owner accepts payments via PayPal. All monies must be received prior to entering the Property. 3 days prior to arrival, the Owner will provide the location to the keys to the home. The security deposit will be held until check-out to ensure that the home is returned in the same order it was received. Refer to Security Deposit section under the Rules and Regulations for the timely return of the security deposit after the tenant's departure.
•Owner or Owner's Agent may enter the premises immediately in the event of an emergency, in order to perform necessary repairs and/or maintenance.
•Tenant shall be responsible for all damage, breakage and/or loss to the premises, except normal wear and tear. Tenant agrees that all pipes, wires, glass, plumbing, household contents, etc., other equipment and fixtures will be in the same condition as at the beginning of our stay.
•Tenant agrees to indemnify and save Owner and Property Managers harmless from all liability, loss or damage arising from nuisance or harm made or suffered on the leased premises by the tenant, their guests or invitees. The Owners and Property Managers will be held safe from any carelessness, neglect, or improper conduct of any persons entering or occupying or visiting the apartment or premises.
•The Owner shall provide utilities, basic kitchen items, furniture and fixtures, linens and towels.

To receive full security deposit home must be returned in the same condition in which it was upon entry.
