(Contract formation)
Article 1
The lessor the SAKURA company ( hereafter called the “ Landlord “ ) and
the rente(URL HIDDEN) ( hereafter called the “ Tenant “ ) have formed the rental housing agreement ( hereafter called the “ Contract “ in accordance with Article 38 of the Leasehold and Rental Housing Act ( hereafter called “ Act “), regarding the object of the lease ( hereafter called the “ Property“) specified in (1) above.
This lease establishes a contract concerning the Tenant’s rent of the Property with the purpose of temporary use for a short period of time. Neither party in this agreement is required to provide grounds for termination.


(Contract period)
Article 2
1 The period of the Contract is specified in (2) above.
2 The Contract will expire at the end of the Contract period as specified above, and shall not be renewed automatically.


(Purpose of use)
Article 3
The Tenant must use the Property only for residential purposes.


(Rent)
Article 4
The Tenant must pay rent to the Landlord in accordance with (3) above.


(Prohibited or limited acts)
Article 5
1. The Tenant shall not transfer the right of lease, nor sublease the Property in whole or in part to any other third-party members.
2. The Tenant shall not enlarge, remodel or move the Property, or make alterations to the Property.
3. When using the Property, the Tenant shall not do anything listed in Table 1.
4. When using the Property, the Tenant shall not do anything listed in Table 2.
5. When using the Property, the Tenant shall not do anything listed in Table 3.


(Tenant’s responsibilities for the care of the Property)
Article 6
The Tenant shall not exhibit dangerous behavior, nor be a nuisance to the neighbors. If the Tenant damages the Property, the Tenant shall contact the Landlord, and follow the Landlord’s instructions and pay for the damages without delay. The Tenant shall compensate the Landlord for the damages.


(Repair)
Article 7
The Landlord is responsible for any repairs that are necessary for the Tenant to use the Property, as listed in Table 4. The Tenant must pay for repairs that are willfully or negligently caused by the Tenant.


(Cancellation of the Contract)
Article 8
1. In the case that the Tenant cancels the Contract before the end of the Contract period, the Tenant will be required to pay the rent in full for the remaining period of the Contract.
2. If the Tenant does not adhere to any of the following rules and the Landlord is therefore unable to continue the Contract, then the Landlord can cancel the Contract.
To use the Property only as a residence as stated in Article 3.
Rules specified in Article 5.
Other rules for the Tenant to observe as specified in the Contract.
3. If the Tenant or co-occupants prove to be affiliated with gang members or their families, (including through common-law marriage) according to the Anti-organized Crime Law, the Landlord can cancel the Contract.


(Cancellation of the Contract by the Tenant)
Article 9
1. The Tenant can cancel the Contract by giving at least a 1 month notice to the Landlord.
2. The Tenant may move out earlier by paying the 1 month’ s rent after notifying the Landlord of the cancellation of the Contract.


(Vacating and Moving out)
Article 10
1. The Tenant shall move out of the Property before the Contract expires(immediately in the event that the Contract is cancelled under the provision of Article 8)
2. The Tenant must pay for repairs that are willfully or negligently caused by the Tenant after the Landlord checks the residence and other attachments when the Tenant moves out.
3. After the Tenant moves out, all left-over items/furniture become the property of the Landlord.


(Illegal use of the property)
Article 11
1. In case that the Tenant does not leave the Property after the cancellation of the Contract by Article 9, the Tenant is forced to pay double the rent, from the date of the cancellation of the Contract to the date of moving out. Likewise, in case of a violation of Article 2, the Tenant should pay the dues in the same way.
2. In case that the Landlord detects that the Tenant is accommodating others not on the Contract, the Tenant should pay the rent in proportion to the number of persons, from the starting date of the Contract to the date of moving out.


(Entry)
Article 12
1. The Landlord can enter the Property, with prior consent of the Tenant, when it is necessary for property management such as maintenance of the structure.
2. The Tenant cannot refuse the Landlord entry for property management purposes.
3. Prospective tenants accompanied by the Landlord can inspect the Property with prior consent of the Tenant.
4. To prevent the spread of fire or in any other emergencies, the Landlord can enter the Property without prior consent of the Tenant. When entering in the absence of the Tenant, the Landlord must notify the Tenant later that he has entered the Property.


(Jurisdiction )
Article 13
In case of any dispute between the Landlord and the Tenant regarding the Contract, the court of jurisdiction is Kyoto municipal court. The Tenant shall pay the Landlord for all expenses including the legal fees for lawyers when there is any dispute about the Contract, regardless of which party initiated the legal dispute.


(Discussion)
Article 14
If there arise any doubts about items not specified in the Contract, or about the interpretation of the Contract, the Landlord and the Tenant shall discuss and resolve them in good faith, in accordance with the Civil Code and other regulations and customs.

Notes

1. The Landlord is not responsible for stolen, lost, or broken property.
The Tenant must be careful of their property, especially valuables.
2. The Tenant must be careful of fire, especially when using the kitchen. Please do not use
gas stoves that are not approved by the Landlord.
3. The Tenant must keep in mind the cleanliness of their room and shared space : the
kitchen, the living room, the stairs, the hallway, the entrance, and the bathroom.
4. The Tenant must keep in mind the comfort of others.

The Tenant must obey the rules.
In case that the rules are not obeyed, the contract may be terminated.


Table 1 (related to Article 5, Paragraph 3)

1. Manufacture or storage of guns, swords, explosives and flammable or dangerous items.
2. Bringing in or installation of large safes and other heavy items.
3. Pouring of corrosive liquid into the drains.
4. Playing television, stereo, piano, etc, at high volume,
5. Performing any acts such as the noises at night that would cause nuisance or displeasure to other residents or neighbors.
6. Keeping of animals that could clearly be a nuisance to neighbors, such as fierce animals and poisonous snakes.
7. Using the property as an office for gangs in contravention of the Anti-organized Crime Law.
8. Letting gang members or their families (including through common-law marriage) on the Anti-organized Crime Law, use the Property.


Table 2 (related to Article 5, Paragraph 4)

1. Placing items in the common areas, such as stairs and corridors.
2. Posting signboards, posters, and other advertisements in the common areas, such as stairs and corridors
3. Keeping dogs, cats, insects and other animals (excluding those listed on the Table1, 6) which cause a nuisance to neighbors, but excluding ornamental small birds and fish.
4. Performing any acts that would cause a nuisance or displeasure to other residents or neighbors and doing them harm.
5. Breaking the waste disposal rules.
6. Bringing and/or producing offensive odors.
7. Arguing with other residents or neighbors.
8. Throwing cigarettes away in and outside the Property and smoking in no-smoking areas.
9. Letting others (family, friends etc) use the Property.
10. Telling the PIN number of the Property and lending the key to others not on the Contract.

Table 3 (related to Article 5, Paragraph 5)
1. Living with person(s) other than those specified in (5) above, including children born during the period of the contract.
2. Being absent from the Property for more than one consecutive month.

【Terms and Conditions】


I understand the following rules and agree to comply with them upon moving into the apartment/shared house managed by the RESISTAY Company.

1. I understand the content of this Contract and agree to its terms in good faith.
In case that there is a violation or falsehood, I understand that I will be required to leave the Property immediately.
2. I will try to communicate with other residents and the management company openly.
In case that I perform any acts that would cause a nuisance or displeasure such as harming other residents physically or mentally, I will be required to leave the Property immediately.
3. In case that I am not able to contact the management company, I will be required to leave the Property.
4. In case that I perform any acts that would cause a nuisance or displeasure to other residents or the management company willfully or negligently, I will be required to leave the Property and compensate the RESISTAY Company for any damages.

In case that any of the above mentioned occurs, I will not object to the Landlord locking my room and removing my possessions.

A fantastic stay! Highly recommended. Comfortable stay for the 6 of us. Kitchen was well equipped esp We cooked everyday and it truly felt like home. Washer n dryer was useful too as we stayed a week. Host provided laundry detergent. The apartment has many electronic gadgets but the host has taken steps to put up explanation how to use them which is useful for us.Location is fantastic.just a step away from the kyoto shiyakusho-mae station and a walk away from sanjo station to go to Osaka n Nara. Nearby shopping malls such as loft kyoto, teramachi, nishiki market and underground grocery store and family mart. Nearby halal restaurant indonesian sama sama and naritaya halal ramen n beef restaurant in Gion.Gion district is abt 10 mins walk along the kamo river. Next to the apartment is the serene kamo river where u can go for your morning and evening walks. The only setback for us is to have to collect the keys elsewhere and having to arrive first day all tired with elderly parents can be rather stressful. However the team is always responsive to all questions raised prior coming to kyoto. Overall a wonderful and comfortable stay for us.We would definitely stay here again without a doubt. Value for money. Thank you.

Very spacious and luxurious. Great location literally in front of subway entrance and around the corner from a main bus stop. Restaurants and shops within a few blocks. Comfortable beds, Japanese toilet with bidet, etc. a nice plus. Washer/dryer is great. Full kitchen with dining room made it nice to cook dinner in one night. Super clean and comfortable. Highly recommended.

This apartment is well located, close to Gion and Pontocho, and steps away from the subway system. It's also quite spacious and modern. You have to check in off-site to get the key, but the Yoko Support Team was both helpful and professional. We enjoyed our stay here!

This is a really nice apartment with a great location - very walkable to a broad range of restaurants and has easy access to buses and the subway. Nice and quiet and perfect for travel with a young child.
