About the updates to our Terms

Last updated: February 5, 2026

We’ve updated our Terms of Service, Payments Terms of Service, some of our other terms and policies (collectively, "Terms"), and our Privacy Policy.

The updates to our Terms and Privacy Policy discussed below are effective immediately for all first-time users beginning February 5, 2026. The updated Terms and Privacy Policy will generally go into effect for existing users on April 20, 2026. After that date, you will need to agree to the updated Terms and acknowledge the updated Privacy Policy in order to book or manage reservations. Our use of your personal information from that date onward will be subject to the updated Privacy Policy.

Capitalized terms not defined on this page have the same meanings given to them in the Terms and Privacy Policy. You can read the full terms in the links below, along with key changes and other important information:

Updates to the Terms of Service

  • We updated the terms to provide additional transparency around Airbnb’s use of recommendation systems.
  • We updated the United States arbitration agreement, including returning to AAA as our primary arbitration provider and confirming that all arbitration proceedings are confidential.
  • We clarified and updated which Airbnb entities certain users contract with, including users whose place of residence or establishment are within U.S. territories, Israel, and the Palestinian Territories.
  • We reorganized the terms to better highlight Airbnb’s identity and background screening activities for United States users.
  • We updated the terms to add a class action waiver for Canadian users.
  • We updated the Terms of Service to reflect changes to Airbnb’s business.

Updates to the Payments Terms of Service

  • We updated the United States arbitration agreement.
  • We updated the Payments Terms of Service to include that Users with Mexico as a Country of Residence will be contracting with Airbnb Payments UK for any booking confirmed prior to March 20, 2026 and with Airbnb Payments Mexico for any booking confirmed on or after March 20, 2026.
  • We updated the Payments Terms of Service to include details about Airbnb Payments Mexico and the new terms for Users with Mexico as a Country of Residence.
  • We updated the Payments Terms of Service to include the right of Airbnb requesting additional information, when a payout method is added to the account.
  • We updated the Payments Terms of Service to include the new US Territories that will be contracting with Airbnb Payments Inc.
  • We updated the Payments Terms of Service to include the right of Airbnb to prevent or deny the use or access to Payment Services, in accordance with certain requirements.
  • We updated the Payments Terms of Service to clarify that if the Host is an Individual, explicitly agrees that is acting on their own behalf.
  • We updated the Payments Terms of Service to clarify that if the Host is acting on behalf of a business, company or other entity, it has sufficient capacity to do so.
  • We updated the Payments Terms of Service for European Users to include the new address of Airbnb Payments Luxembourg.
  • We updated the Payments Terms of Service for European Users to include the right of Airbnb to terminate the account due to dormancy.

Updates to the Privacy Policy

  • We updated the "Personal Information We Collect" section to consolidate our privacy notice supplements into the main Privacy Policy, and provided further clarity about the categories of personal information you choose to give us and personal information we collect in order to provide our services and new product features.
  • We clarified the purposes for which we use that personal information and how we process and share that personal information within Airbnb and with our service providers.
  • We provided more detail about how we use personal information to develop and improve our AI.
  • We made updates for compliance with upcoming laws and regulations.
  • We added a new supplement for users residing in the Republic of Korea.
  • We updated the data controllers for users residing in Mexico and the United States Territories. We also updated the data controller for all activities, aside from Payments Services, in Israel or the Palestinian Territories.

Updates to the Host Damage Protection Terms 

  • We made changes for organization and clarity.
  • We clarified the Hosts’ requirement to take reasonable care to avoid loss.
  • We added a definition of “Legitimate and Verifiable Evidence” and clarified that this must not include AI generated content.
  • We updated and clarified the evidence requirements in respect of smoke odor and acceptable types of remediation.
  • We updated and clarified Household Linen stain eligibility.
  • We added a “Consumables” definition and clarified their eligibility and ineligibility.
  • We updated the United States arbitration agreement.

Update to the Australia Gift Card Terms and Conditions and the New Zealand Gift Card Terms and Conditions

Effective 12 September 2025:

  • We clarified what charges Gift Cards can be applied towards.
  • We added that Gift Cards may not be accepted if obtained from unauthorized sellers.
  • We clarified that these Gift Card Terms may apply to you after your entire Gift Card balance has been spent.
  • We made changes for organization and clarity.

Here are a few common questions that you may have about this process.

I created my Airbnb account before February 5, 2026. What will happen after April 20, 2026?

After April 20, 2026, all users who registered their Airbnb account before February 5, 2026 will be asked to review and agree to the updated Terms and review and acknowledge the updated Privacy Policy. You will have to agree to the updated Terms and acknowledge the updated Privacy Policy before you can continue to book stays, receive future bookings, or use your Host tools. If you disagree with the updated Terms or Privacy Policy, we'll give you information about your options for completing existing reservations and canceling your account. If you have any questions or encounter any difficulties during this process, please email terms@airbnb.com for assistance. Existing users will not be able to agree to the updated Terms and acknowledge the updated Privacy Policy earlier than April 20, 2026. Your continued use of the Airbnb Platform from April 20, 2026 will be subject to the new Privacy Policy.

I created my Airbnb account on or after February 5, 2026. Which Terms apply to me?

If you registered your Airbnb account on or after February 5, 2026, you already agreed to the updated Terms of Service, Payments Terms of Service, and other terms and policies, and you acknowledged the updated Privacy Policy. The updated Terms and Privacy Policy apply to you and there is nothing more you need to do.

How do the updated Terms and Privacy Policy apply to my upcoming confirmed bookings?

The updated Terms and Privacy Policy will apply to all activities (including existing, confirmed bookings) on the Airbnb Platform from the time you agree to them. If you are an existing user and you do not agree to the new Terms and/or do not acknowledge the new Privacy Policy, the previous version of the Terms of Service, Payments Terms of Service, and Privacy Policy will continue to apply to bookings you confirmed before April 20, 2026. Regardless of whether you agree to the new Terms and/or acknowledge the new Privacy Policy, your continued use of the Airbnb Platform from April 20, 2026 on will be subject to the updated Privacy Policy.
